While this business owner hides behind his so-called contract, there is no statement that the store policy allows him to retain both the rifle AND the monies forever. It has been 15 MONTHS since this so-called sale. It feels more like theft. We have neither the rifle nor the money. That is the owners CHOICE. I have spoken to other gun dealers who consign firearms and they all mentioned reputation. They are shocked, but not surprised. Time to move to next step it sounds like.

    Business Response

    Date: 02/14/2024

This situation has been explained to both you and your husband several times, ad nauseam, over the phone and in person. When I most recently spoke to you on the phone, you admitted that you now understood that the issue at hand is the responsibility of the ****** ************* and that we have absolutely no control over the state police, their background investigation, their policies, nor their practices. Also, the contract that your husband signed states clearly that, "Payment of consigner will be paid by company check or cash at our discretion within five business days of the date of transfer to the buyer."
The money for the consignment sale is, in effect, in escrow; this has been explained to both you and your husband several times. Under both state and federal law, a "transfer" has not occurred until the buyer has passed a background check and taken possession of the firearm. As the buyer is listed in a "Delayed" status by the ****** ************ firearms unit, it is our company policy not to release the firearm until the background check has been cleared. The buyer has stated that they want to wait for the clearance, as they have no reason to believe that they will not be issued a "Proceed" response at the conclusion of the background check. As long as their background check is pending, I cannot simply "return" the rifle to your husband. As I also explained to you on the phone, there are thousands of ********** who have currently been placed in an arbitrary "Delayed" status; this is readily verifiable through a number of sources, including the **************************. I advised that you should lodge your complaint with the ************* as well as your local congressional representatives about the delay in the process.
You verbally acknowledged on that call that you understood, and even stated that you would remove your negative review on ******* and withdraw your complaint with the Better Business Bureau. As of today, February 14th, you have done neither.
We received your husband's certified letter, and when I called to address the matter with your husband on a recorded line, he threw a tantrum and hung up on me when he didn't like what he heard. Apparently it is a family trait, since you have thrown similar tantrums on ****** and the Better Business Bureau before ever even contacting us directly with your complaints or inquiries. In response to your husband's outlandish and absurd demands in his certified letter, our response is, no. We will not be releasing the buyer's information, to include their social security number and other sensitive information included on the ***** Form 4473 as we are legal custodians of those records, and we safeguard our clients' personal information. Likewise we will not be releasing account statements, correspondence, notes, credit card receipts, among other asinine demands. Since you have made a thinly veiled threat to "pursue next steps," you are welcome to have your attorney contact us for our counsel's name and contact information. Alternatively, you may feel free to contact us directly to have the situation explained to you again.

On 12/8/22 I overnighted a milled glock slide worth approximately $600 to Coat of Arms for a cerakote treatment. For this service, I sent $100 to the paypal address the owner provided by the owner (*********************** *******, Ferox Group LLC). On 1/6/23 I reached out to both the owner personally as well as the shop front to inquire when I could expect my property. It took them 5 months to find a tracking number which turned out to be the wrong package. This is extremely concerning for a company that sells, assembles, and ships firearms all over the country. After discovering it was the wrong tracking number they were finally able to find the correct tracking number and conclude that the package had been lost in the mail. In a cellphone conversation on 5/4/23 The owner promised me that he would replace my property and refund my PP payment. I have not received a replacement, my PP refund request (sent 5/31/23) goes unanswered and the owner doesn't respond to texts, emails, or phone calls. The nature of my dispute is that I payed this man to provide a service, and that while under the care of his business my property was never returned to me, and although I was told I would receive a replacement and a refund, that never happened. The business/owner has not tried to resolve this in any way, in fact he's pretending it never happened.I cannot succinctly describe how frustrating this experience has been for me. Worst retail experience of my life.I am attaching an email I sent to his personal email on 4/15/23 after spending months of no communication. He claimed to have never received it, I believe he chose to ignore it because any response would acknowledge it and create a paper trail that he could be held accountable to.

    Business Response

We are not able to respond in detail at this time, other than to say that the complainant has been unwilling to return calls in an attempt to communicate. The complainant has also used social media as a platform to recruit and influence other third-party individuals unrelated to this complaint or this company to leave fraudulent reviews on ******* Yelp, and other platforms. We are currently exploring litigation options for defamation. On advice of counsel, we will not be able to comment further while litigation is pending.
