      United Consumer Financial has put a charge off on my account. I had received the product before the Covid 19 pandemic in which I contacted them in order to try to set up a better payment plan due to loss of certian funds. I even tried to pay a lump sum of money to stop them from placing any late details on my credit report in which they said they would not and would work with me. Only to find out that they were continuing to charge me the same thing and kept calling me repeatedly after I had already set up an agreement with another service representative. I honestly just want it off of my credit report at this point as calling them has become a complete hassle because I can either never get in touch with someone or im given the run around. Im even willing to work with them to pay off the remaining debt if that would help get it off of my credit report but im having a hard time even doing that. Ive had a very tough time with this company and just wish they would do right by their customers. I wish they would have kept their word when it was promised. Im getting absolutely nowhere with their customer service representatives. The account seemed to be reopend without my knowledge and another fee was added for some odd reason. I just want to be done with this company as it was an absolutely horrible experience

      According to our records, you signed a retail installment sales contract (the “Agreement”) for the
      purchase of a Kirby Cleaning System on January 25, 2020. The Agreement was between you and the
      independent merchant who sold you the product. UCFS purchased the Agreement, thereby, indirectly
      financing this transaction.

      UCFS reviewed your account history and have determined that the negative credit reporting performed
      on your account is accurate based on your payment history. You were notified of the delinquency and
      subsequent negative credit reporting by telephone call and USPS mail.

      UCFS maintains that it followed all applicable rules and regulations in the opening and servicing of your
      above named account ending in 5266. As a courtesy, UCFS decided to delete the credit reporting of the
      above named account from your credit reporting history. This modification may take 30 to 90 days to
      reflect on your credit report file. Please retain this letter for your records as confirmation of this action.

      I originally called this company to get help paying back taxes. I was told they could help me by cutting what i owed in half and they would electronically take $127 a month to pay the IRS. A year in i get a letter from the irs saying I'm delinquent on my payment plan. Found out through the irs that they had not paid anything. Come to find out the fees were going to pay their attorneys ect. So i paid in over $1700 and now I've stopped payment on there automatic withdrawal with that said my credit score has plummeted. And its ruining my credit. So this is destroying my credit and my livelihood.

      ******* This constitutes a grave breach of contract by ******* * ****, leading to extensive damages under the agreement made in December 2022. ******* pledged to diminish my IRS liability from $14k to $2-3k, requiring my $5k financial commitment through UCFS. However, over the past two years, ******* failed to fulfill its commitments, resulting in financial loss, credit damage, and immense stress. Despite remitting nearly $2k in consistent payments to UCFS, ******* has not rendered the promised services. The IRS rejected the Offer in Compromise due to ********* incompetence, unprofessionalism, and misguided financial advice. ********* unprofessional conduct is apparent in frequent representative changes, redundant paperwork requests, and misleading advice. The lack of consistency and disrespectful behavior, including a representative managing my case while cooking, are unacceptable. ********* use of UCFS as a third-party for payments seems an attempt to evade accountability, raising ethical concerns and implying a strategy to shirk responsibility for unfulfilled services. Despite legitimate concerns, ******* and UCFS refused to disclose legal representation information, casting doubt on transparency and legality. The IRS no longer offers an OIC, eliminating the promised resolution. ******* is solely attempting to reduce my liability based on income, a task I could have undertaken independently without the need for their services and the accompanying $5k loan. I asked UCFS & ******* to suspend payments until resolution is achieved, but I was denied. I demand either a refund of payments made or a temporary suspension of payments to UCFS until a satisfactory resolution is reached. Additionally, I insist on the immediate reversal of any adverse credit reporting resulting from this situation. These actions are crucial to rectify the harm caused and provide a fair resolution. I expect swift attention to these requests to prevent further legal action.

      debt used to purchase the product or service. Tax Rise Inc. (“TRI”) is one independent merchant with
      which UCFS has a contractual relationship. TRI like other merchants that UCFS works with, is not an agent,
      legal representative, or corporate affiliate of UCFS.

      UCFS contacted TRI regarding your complaint. TRI indicated that they have not breached their
      agreement with you and services have been provided to you in accordance with the Service Agreement
      between them and you. Currently, TRI is waiting for the IRS to officially release the offer in compromise
      so that they can move onto the next resolution. According to TRI, you were advised of the additional
      resolutions TRI can submit to the IRS on your behalf.

      Although services were provided, TRI agreed to cancel the agreement between them and you.
      Accordingly, UCFS is in the process of closing your account ending in 688 as a result of the cancelation.
      This action includes notifying the credit reporting agencies to delete the reporting of the above named
      account from your credit report.

      With that said, it wil be noted that I Spoke with ****** from ******* and she understood that ******* promised to me in the begining of engagement that they guaranteed a reduction in my monies owed to the IRS base don teh information I provided, and because this has not been satisfactory, and the IRS rejected their OIC despite their promise to me, she agreed to cancel the loan.

       

      I accept the offer from UCFS for cancelling my loan and not require any payments starting today, 02/29/2024 and that all reporting to the credit agencies that are negative in nature will be removed.

I have spoken with customer service at ****** ******** *** **** employee #9979 which informed me of several discrepancies with the information they have on file; email/phone, and an old address and said that a ****** ******* was purchased in my name for the amount of $7,582.00 from a company called ***** ****. A hard inuire occurd on my credit report on 10/22/23 from ****** ******** *** *** for a person loan of $7,582.00. and was report on 10/26/23 on my ****** *****. This was not me and I have filed a police report for with the Sterling Heights police department, case number ********* for identity theft. ****** ******** *** *** stated they would mail me fraud paperwork to fill out for identity theft, which I have not received yet. I have reached out to ***** **** and spoke with ****** on the phone, ************ who stated she had no record of me ever applying for a dog in their system and stated “I don’t think we’ve ever sold a ****** ******* for that much money before” but would inform the owner of the company of the situation. I have never and do not have a contract with them, this is a fraudulent account that should be removed from my credit report.

      The reported amounts of my loan is inflated which is a violation of UDAAP they have the loan amount as 5250 which is the amount that will paid with interest over the life of the loan if I pay only the minimum payments. My loan is for far less. The vendor stated they can report what ever they want incorrect when you report a new loan it’s the financed amount. We have copies of the signed documents and they are false reporting and I am filing a complaint with the CFPB as well

      reporting agencies. You signed a financing contract that computes interest on a precomputed basis.
      Your account balance is expressed as a sum containing the principal and the amount of the finance
      charges computed in advance. UCFS collects finance charges with each of your monthly payments as we
      earn finance charges each month during your contract, therefore, interest is included in the amount
      reported to the credit bureaus.

      Please note that the method of interest computation is reflected in a disclosure on the financing
      agreement that you signed.

      United Consumer Financial Services received the complaint you submitted through the Better Business
      Bureau regarding your account with UCFS ending in 509. Thank you for the opportunity to respond to
      your concerns.

      According to our records, you signed a retail installment sales contract (the “Agreement”) for the
      purchase of Tax Services on November 12, 2020. UCFS verified the terms of the Agreement with you on
      November 13, 2020 using the telephone number that matches the telephone number included in your
      complaint. The Agreement was between you and the independent merchant who sold you the Tax
      Services. UCFS purchased the Agreement, thereby, indirectly financing this transaction.

      UCFS completed its investigation of your claim that you were a victim of Identity Theft in the opening of
      the above named account ending in 509. UCFS determined that you have not provided sufficient
      information to conclude that you were a victim of Identity Theft in the opening of this account. As stated
      above, the telephone number included in your complaint matches the application submitted for financing
      consideration. In addition to the telephone number matching our records, the physical address you
      provided in your complaint matches our records.

      UCFS spoke to you in January 2021 regarding payment arrangements on the above named account ending
      in 509. During this telephone call, you authorized an electronic funds transfer for $278.68 on January 7,
      2021 and authorized a recurring electronic funds transfer for $278.68 on your due date each month. You
      did not mention a problem with the account ending in 509 or that you believed you were a victim of
      Identity Theft in the opening of the account ending in 509. The recurring payment was cancelled on
      December 16, 2022 when your bank notified UCFS that you had revoked authorization. UCFS sent you a
      letter advising you that the recurring payment method had been cancelled. The letter was sent by USPS
      mail service to the address matching the address on your complaint.

      According to our records, your account ending in 509 charged off for non-payment on or about June 7,
      2023 in the amount of $3,622.84. You were notified of the delinquency and subsequent negative credit
      reporting via USPS mail along with attempting to contact you using the phone number that matches your
      complaint.

      UCFS reviewed the credit reporting performed on the above named account ending in 509 and
      determined the credit reporting to be accurate based on the Payment History.
      The Fair Credit Reporting Act §623(a) (8) (D) provides as follows:

      (D) Submitting a notice of dispute- A consumer who seeks to dispute the accuracy of information
      shall provide a dispute notice directly to such person at the address specified by the person for
      such notices that –

      (i) identifies the specific information that is being disputed;
      (ii) explains the basis for the dispute; and
      (iii) includes all supporting documentation required by the furnisher to substantiate
      the basis of the dispute.

      If you have additional information to support you were a victim of Identity Theft in the opening of the
      above named account, please provide that to us for further review.

      United Consumer Financial Services (“UCFS”) received your Better Business Bureau complaint regarding
      your account with UCFS ending in ***. Thank you for the opportunity to respond to your concerns.
      According to our records, you signed a retail installment sales contract (the “Agreement”) for the
      purchase of a puppy on October 4, 2021. The Agreement was between you and the independent
      merchant who sold you the pet. UCFS purchased the Agreement, thereby, indirectly financing this
      transaction.

      In your complaint, you allege that UCFS began credit reporting an unknown status for the above named
      account ending in *** prior to the purchase date. UCFS denies your allegation. UCFS could not have
      reported an account status to the credit reporting agencies prior to October 4, 2021 because UCFS did
      not have an application and contract on file prior to October 4, 2021. UCFS did not have your personal
      identifying information prior to October 4, 2021 and could not have reported an account status for an
      account that had not been created yet.

      UCFS completed our investigation and concluded that the credit reporting performed by UCFS is
      accurate and no modification is appropriate. UCFS encourages you to file a dispute directly with the
      credit reporting agencies regarding this matter.

      UCFS maintains that it followed all applicable procedures in the opening and servicing of the above
      named account in accordance with applicable laws and regulations.

      I was contacted by someone saying she was ****** ******** ** ********** *** ******* saying I had a $5,800 tax balance with the IRS, she knew my name, my deceased wife name and banking account information (account number). She stated that she wanted to assist me with this matter, and did I have the money to make the payment, when I told her I didn't she transferred me to someone who suggested I use their finance company to settle the debt. I told Ms. Martinez, that I didn't know of any tax debt with the IRS she told me it was from old taxes when I filed with my now deceased wife. I was connected to the finance company who set up an account for me to make payments to the IRS. I spoke with a friend after doing this and they suggested I contact a tax professional. I contacted a tax preparer, Vera Gardner, who went to my account online with the IRS and also contacted the IRS and found that I did not have a balance due to the IRS and she was contracted by the IRS to collect the debt. I contacted the Finance Company, United Consumer Financial Services Company and explained the fraudulent activities of ********** Tax Experts and they said it was nothing that they could do because they paid a fee to ********** Tax Experts on my behalf to do services for me (services I didn't need because I do not have a tax issue with IRS and my understanding was that I was paying a balance due to the IRS and not a fee for any services). It is my opinion that United Consumer Financial Services Company might be aware if the fraudulent activities of ********** Tax Experts.

      United Consumer Financial Services received the complaint you filed through the Better Business
      Bureau. Thank you for the opportunity to respond to your concerns.

      UCFS contracts with independent third-party merchants to purchase consumer contracts from merchants
      that sell products or services. UCFS then holds the consumer’s retail installment contract and services the
      debt used to purchase the product or service. ********** Tax Experts (NTE) is one independent merchant
      with which UCFS has a contractual relationship. NTE like other merchants that UCFS works with, is not an
      agent, legal representative, or corporate affiliate of UCFS.

      UCFS spoke with the merchant who sold you the tax repair service; the merchant agreed to cancel the
      original contract between them and you. Accordingly, UCFS has also closed your account ending in 8395
      as a result of the cancelation and you are wholly released from the above obligation to UCFS. This
      action includes notifying the credit reporting agencies to delete the reporting of the above named
      account from your credit history. Please allow 30 – 90 days for the credit reporting agencies to update
      their records.

      Please contact the merchant directly with any further questions or concerns as UCFS no longer holds or
      services the debt.
