On Tuesday July 27th 2021, the homeowner signed a contract with Star City Concrete to have landscaping gravel placed, and to have a 26'x34' concrete pole-barn floor poured. The sum of the work was $10,280 ($6,630 was allocated directly to the concrete slab). The contract has been paid in full. The concrete floor was poured on September 15th, 2021. Prior to starting work, Star City stated (highlighted in attached email string) that they believed portions of the grade in the pole barn had not "settled" enough, prior to pouring the concrete floor. They poured the floor anyway, and did not perform compaction of the grade laid for the concrete floor. About 1 week after the floor was poured, deep cavities developed around the perimeter of the slab. These cavities are significant, and the slab is now compromised and extremely vulnerable to failure. Star City was contacted immediately once the cavities developed, but took no ownership of the issue and stated the homeowner was responsible for compaction of the soil under the poured slab. Furthermore, Star City provided contact information to a company that specializes in repairing damaged concrete, and instructed the homeowner to contact that company in order to fix the issue. Star City then closed communication by denying any responsibility for their work. The contract explicitly states compaction of gravel base is part of the services rendered (see attached contract, stating "add crushed gravel base as needed up to 4in depth, compacted"). These services were not performed. In summation: the floor is faulty, no repair offered, responsibility was denied, and no restitution was provided to the homeowner. I am seeking full reimbursement of the contract fees associated with the pouring of the concrete floor ($6,630), as the floor will need removed before being re-poured by another contractor. Star City stated that they are incapable of repairing the slab, so a repair by Star City is not an acceptable resolution.Business response

Business Response /* (1000, 10, 2021/12/01) */ The last email correspondence from us to Mr. * after he threatened legal action stated our position, which is as follows: We are very sorry you feel this way, but when dealing with the builder on these barns for so long, he expresses to the homeowner the need to water the posts before our coming out because of settling; we also reminded you that this needs to be done before our arrival. This is because the builder fills the post holes with the dirt that was removed when the holes were dug, per their specs, and that is what ends up settling, and we had no part in this portion of the project, which is why it is, therefore, not something we are responsible for. Justin even questioned a few days before installation that it did not looked like it had settled and asked you if you had watered, which you replied yes. Whatever happens with what the homeowner is supposed to do before we arrive and what actually is performed or not is beyond our control, and there is no machine or equipment to ensure the compacting properly around posts, except for water and gravity. Again, we are sorry that you are having this issue, but hope that you do see why we do not feel it is a mistake on our part. Legal action was not threatened, or even mentioned, prior to Star City communicating that they would not be resolving the issues with their work. Star City's reply that grade compaction is not possible, and telling the customer to contract additional services from a concrete lifting company to repair Star City's newly poured slab, is not an appropriate response. This was, and continues to be, a matter of faulty deliverables with no attempts at restitution or resolution from the vendor.
