    A $1,000.00 deposit was given via credit card in order to hold a spot on the schedule to have services. Circumstances changed and the services had to be cancelled. When cancelling services I was advised that the $1,000.00 was not refundable even though the cancellation was over a week before services were to be provided.

          I was contacted in the last half of October
    to give the complainant’s husband a bid on insulating their new home. At this time,
    he informed me that they were getting other bids which is standard practice. On
    November the third I sent a text giving the husband my quote. The husband asked
    when could we get to it and I informed him that we are scheduling the first
    week of December and a $1000.00 deposit is required.    
         We have been spraying foam for many years
    and we have an excellent reputation and being that, we stay very busy.  The complainant’s deposit holds a block of
    days for them.  It is not for materials
    or other things we can use on other jobs. The deposit gives them a place in the
    schedule.   We have had customers call who needed work
    done within a certain time frame and they have gone elsewhere when I tell them
    I am scheduled ahead.   Once these people
    move on to another company, I cannot just call them up and say someone changed their
    mind, I can now do your job sooner. They are gone!    Can
    someone come along and say I will take that spot?  Maybe, but that does not erase the loss from
    the customers that moved on.  
        We are a long-time member of the BBB and
    have great respect for the organization and value our rating as well.   As a member of the BBB, I feel it is there to
    protect me as a business as well as the consumer.  It is very unfair for a consumer to reserve
    time on a company’s busy schedule and then just send a text and say sorry,
    changed my mind.   That is not fair to me
    or the people I turned away.    After the
    complainants told me they had a delay in financing and had to cancel, I
    informed them that no, the deposit is not refundable, but I will honor the
    original price and the deposit made for 6 months and felt this was very
    fair.  My opinion after reading the post
    on their social media is that it’s not a financing issue but that they found
    someone to do it, cheaper or sooner?

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.


    Yes I understand that the money was to hold a spot, but there was no contract signed saying that this deposit was non refundable. There was no mention that if cancellation occurred that the money wasn’t going to be refunded. There was 0 time wasted because nobody even came to look at the project beforehand. Cancellation was over a week and plenty of time to find someone to take that spot. If the money wasn’t for materials then I see no good reason why the money cannot be refunded.
