Description:
Constituent had a concrete work done but is having issues with it. The company is Maxima Concrete. He had it done in 2022. He
paid 26,312.00 but in 2023 winter spots started showing up so he contacted the company who sent someone out who told him it

Hello,
***** ****** ,wife of ****, sent us photos of damages to their driveway, done by an asphalt truck, from another company, We had just completed a concrete driveway for them and we offered to help them out by power washing and sealing the damaged area. We completed the power washing and sealing work June 2024. The damage was not done by Maxima Concrete and we do not offer any other services regarding resurfacing. We understand that this is was an unfortunate event but we tried to help out with the resources we have.

I am rejecting this response because we are in exactly the same place as before I wrote a formal complaint to BBB. I had tried on four separate occasions to detail my concerns with specifics from the contract and subsequent written promises the company made to no avail, which is why I ask for a refund now. I had hoped Maxima would make right what is not right without a formal complaint. Based on Maxima's own assessment of the problems with the driveway and an assessment from an outside concrete expert, I believe the company has not fulfilled all of its contractual obligations or installed the shared driveway in a workmanlike manner. Maxima's promise to return in Spring 2025 will be the third attempt to install correctly a short pathway between the two garages; the logic of correcting the slope to eliminate pooling water applies to other parts of the driveway that Maxima has ignored. In addition, the insufficient width of the drain Maxima installed the second time across the driveway between our two homes means water still pours into my patio when it rains because the slope is incorrect. The failure to install adequate expansion joints between the concrete driveway and our house foundations has created cracks in my glass block window that have developed in the past few months and two continuous and parallel cracks in the driveway alongside the foundations of our homes, of 40 and 30 feet respectively. I include the original documents detailing these issues.

****** *******oney, so I now request a full refund. Their contract promises to compact the subgrade as required, install expansion joints as needed, slope the new concrete to properly shed water. The slope is flawed. Rain pours from my neighbor’s garage area onto my back patio and makes my pathway dangerous during winter when it freezes. The grate installed the second time does not perform as Maxima promised: it does not extend far enough across the driveway to prevent water shedding onto my patio; the grate is 30 inches shy of covering the drive completely. Rain pools in the middle of the driveway. The second time, Maxima buried our downspouts but apparently didn’t dig deeply enough to prevent cracking above the buried downspouts. This continuous cracking also arises from the fact that Maxima installed no expansion joints along the foundations of our homes, so concrete rubs against the foundations; several cracks have also developed in a glass block window that the concrete presses against.Business Response

Dear Ms. *****,
I am legal counsel for Maxima Concrete LLC. Please let this letter serve as a formal response to the complaint you received against my client. Prior to the filing of this complaint, I had already communicated directly with Ms. ******* via e-mail communication, as the enclosed documentation will demonstrate. My client agreed to return to Ms. *******’s home to do repairs in the spring or summer of 2025 and she agreed per the attached e-mail dated November 29, 2024. Due to Ohio weather, this is the earliest my client can perform service work on concrete installed outside, which was also explained to her. Ms. ******* did not demand a refund from my client, as she did in her BBB complaint, instead she requested repair work.My client will not issue a refund to this client. Per the terms of the signed contract, they are not required to do so. Regarding the sidewalk section between the garages that has a small belly in it, they have offered to cut it out and replace it. My client is also willing to make the color of the concrete more uniform. Maxima confirmed they installed expansion joints where they deemed appropriate, and the slab has wire mesh throughout and residential poly fiber in the concrete.
My client will not replace the entire driveway solely at their expense. Some items Ms. ******* complains of were not included in the original signed contract and will require additional payment by the homeowners. These requests include alteration of slopes, and more drains added. As explained to Ms. *******, my client is willing to negotiate, but those actions would incur new costs per terms of the contract. As the contract clearly states, in paragraph 2(k), “Any changes in project scope differing from estimate sheet will result in appropriate change of price.”
My client is a reputable and ethical Ohio business who stands behind their work. The owner of the business, as well as management have continued to communicate with these homeowners and returned to the project to discuss the requested repairs, as well as perform additional work. They want to resolve this matter amicably and fairly with the homeowners. My client will follow the terms of the signed contract. They will return in the spring or summer of 2025, as agreed, and complete the work they already agreed to do with the homeowners through me as their legal counsel. Maxima's position remains unchanged. ****** ******* agreed through Maxima's legal counsel in to have Maxima return in the Spring of 2025 to perform specific work as explained in the initial response creating a valid contract between Maxima and Ms. *******. Maxima performed significant work on this project and will not issue a refund. As previously stated in both e-mails to Ms. ******* and in Maxima's formal response to this complaint, any requests for services outside the scope of the original contract signed by BOTH parties will require additional costs. I am rejecting this response because it avoids addressing in a meaningful way the issues that I raised first with Maxima itself in four separate letters and more recently twice through the BBB. Unfortunately, nothing has changed. Maxima's response ignores promises of both the original and amended contract (which I have already attached). I had wanted Maxima itself to redress these legitimate concerns, without outside intervention, but when Maxima said the company was going to charge me for work that they should have already performed correctly, I contacted the BBB for help. Since the company continues to refuse to live up to their contractual promises, I had no other choice except to ask for a full refund. The legal counsel's response claims that our money will not be refunded because the company has performed work on the driveway already, but this makes no sense to me because some of the work, as I have detailed, is not up to Maxima's own contractual promises or to workmanlike industry standards. Maxima has done some of the work incorrectly (the grate is insufficiently wide to correct for the incorrect slope of the shared driveway that pours rain water from my neighbor's garage area onto my patio; rain water pools in the middle of the driveway); in another case, Maxima has failed to do inexpensive, standard work of the concrete industry (install expansion joints between the two house foundations and the cement driveway to avoid problems that have already developed such as my glass block window cracking and two 30-foot plus cracks developing alongside the house foundations themselves). I confess that I am unable to understand why I should be financially responsible more than once for getting the company to perform their work correctly; we've already paid almost $20,000 for a driveway that neither looks nor acts like other people's new driveways. Maxima's promise to return in May 2025 is to correct FOR A THIRD TIME a pathway that has been INSTALLED INCORRECTLY TWICE before, so it is not a new contract in any sense that I understand. I will say in conclusion that my neighbors and I have owned homes for over 25 years each, and we have never had a problem with any contractor.

I contracted with Maxima Concrete LLC to replace my concrete driveway and several feet of sidewalk leading into our home. The initial crew removed the concrete on Aug 6 and prepped for the replacement. I had to ask the crew to return after the initial removal to compact the base in a uniform way. The did that approximately a week later. It wasn’t until 16 Aug that Maxima returned to pour the concrete. This was after delaying for 3 days due to a rainy forecast. We never got that rain. So on Monday the 16th August the crew arrives on time at 7:00am followed by the concrete supply truck. The crew from Maxima worked for the next 3 and half hours pouring and finishing my project. It was however sprinkling rain at the time. I asked the job Forman about the rain and he assured me it would not be an issue. It was. After they finished the concrete and shortly after they left I noticed pot marks developing in the entire project less the approach. I took multiple pictures and video for the record. After verifying with other Concrete professionals, it is apparent the entire concrete has been compromised and will be subject to advanced cracking due to the pot marks left behind in their product.
I have contacted the company the following day to provide pictures and details. I was assured the owner is a perfectionist and will want to see the project results. Multiple text messages to the company and finally a response that the owner was out of the country. His return would be the following week. Again the assurances that he would come look at the results. Another week goes by an no communications from Maxima Concrete. I text again and received a response the owner had developed Pnemonia and I would be his top priority once he has recovered. I file this on the 21 Sep and have yet heard from Maxima ownership.Business Response

In our industry we have a lot of variables that indicate the timing of our projects. Weather is always the biggest battle. In this specific case a tree dripping water from a previous rain shower left spots on new concrete surface. We did come to a resolution with the customer and will stay in connection with the customer for any further issues. The follow up appointment took place on 10/4/2024.
