My neighbors tree fell in my yard. My family and I started cleaning up the portion of the tree that was in my yard. My uncle came to help with better saws than we had. Neighbor had not communicated with us as to his plans.

My uncle came and started cutting the downed tree that was in MY yard. This contractor starts yelling at him to stop, and let the professionals handle it. That the neighbor had hired him to do the work.

We were trying to get it cleaned up to ensure no citation from the township and to get to our own fruit trees that were trapped under this tree to assess the damage.

This contractor, nor the neighbor sought permission to enter our property to do work. We explained all this to the contractor, and also told him to be mindful of the fact we have trees we want to keep that are trapped under this neighbors fallen tree.

At one point he said that our trees were hindering his ability to do his job. We watched him yanking on pieces of the neighbors tree that were trapped in our tree because the neighbors tree had two connecting branches that had one of my fruit tree limbs between them. We also watched him cut big logs 2-3 feet in length up to 12+ inches round and just let them drop on the apple tree trapped under the fallen tree we watched him lay heavy branches he cut, on top of the limbs of one of the trees, causing further damage to the base, as well as watched him walk over the base area. He also cut several of the limbs with the chainsaw on our fruit trees.

We still have a huge pile of tree limbs in our yard that belongs to the neighbors tree. No communication from either as to if they are being abandoned, which would allow us to dispose to them, or if they plan on removing them.

Statement from Joshua Bryant, Associate of Woody Bryant’s Tree Service

On June 19, 2025, I was dispatched to assess and remove a large portion of a fallen tree that had landed on Mr. and Mrs. ********’ property (damaging their fence) and extended into the neighboring yard. The ******** acknowledged the tree was theirs and wanted to take responsibility by having it cleaned up and removed. We had no contract or agreement with Mrs. *********, the individual who filed this complaint.

When I arrived, no one was outside. About 10–15 minutes into the job, Mrs. ********* came out with an older man. Without speaking to me, assessing the situation, or considering safety, he began cutting from the upper side of the fallen tree. At the same time, I was working from the lower hillside—where the tree, weighing over 2,000 pounds, was under significant pressure due to how it had fallen. I immediately and firmly voiced my concern, as his actions created a serious risk of the tree shifting or rolling onto me.

It started raining heavily during our conversation. Mrs. ********* shared her concerns about her apple trees. Unfortunately, the trees had already been severely damaged by the weight and impact of the fallen tree. I took extra care not to cut or damage them further, even though avoiding them made the work much more difficult due to the tree’s size and position.

In regard to the pile of brush that is in their yard, it was NOT cut, pulled, or staged by me. Mrs. ********* had the elder man and other members of her family cut and haul those branches to another location on her property. I understand there may be confusion however our team only handled the what we cut as agreed with the ********. We are not responsible for any other work or debris on Mrs. *********’s property.

For 3 decades, Woody Bryant’s Tree Service has proudly served the Dayton area with a commitment to customer satisfaction—and we’re not slowing down anytime soon.
