The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.
On Jan. 28,2025 the Ohio Attorney General's Office filed a civil lawsuit in Franklin County Common Pleas Court against defendants Way 2 Go auto Sales LLC and Kofi A. Bimpeh alleging they engaged in unfair and deceptive actions and practices that violated the Ohio consumer protection laws including the Ohio Consumer Sales Practices act and the Odometer Rollback and Disclosure act.
The lawsuit states that defendant Way 2 Go Auto Sales LLC operated as a used motor vehicle dealer, and that defendant Bimpeh resides in Ohio, and alleges that in some instances the defendants did not have physical possession of the titles and/or the vehicles were not titled to the defendants on the dates the vehicles were sold to consumers, failed to file applications for certificates of title within 30 days after assignment or deliver of motor vehicles, failed to obtain certificates of title on or before the 40th day after the sale of motor vehicles, and misrepresented the actual mileage of the odometers in the written odometer disclosure statements and bill of sale proved to some consumers and by doing so misrepresented the condition and reliability of the vehicles, and that odometer discrepancies provided to some consumers were the result of the defendants allegedly rolling back the odometers before selling the vehicles to consumers, and in some cases defendants did not disclose that they were selling rebuilt salvage vehicles to consumers prior to the execution of the purchase agreements,
The state is asking that the court order the defendants liable to all consumers found to have been damaged, impose civil penalties, prohibit the defendants from engaging in consumer transactions as a supplier until they have satisfied all restitution, civil penalties and costs ordered by the court, and prohibit the defendants from maintaining, renewing or applying for an auto dealers or salesperson license
