In march of 2023, I purchased a 2019 Kia Soul from Clintonville Car Sales. The following month, April 2023, my brakes and rotors needed completely replaced because they DIDNT put a piece in my car. It cost me 700 dollars, which as a teen mom I don’t have. They also warned me that one of my car tires was the wrong size, I need that fixed and an alignment. I’ve been trying to contact Clintonville Car Sales since before I took my car to get fixed in April. “Sarah” the manager claims she is the highest person there, and they don’t have a general manager or owner. I have been calling for months and every time I do Sarah “wasn’t there” and nobody would leave her my number or give her my email. She told me since today (June 3rd) when she FINALLY decided she wanted to answer my calls, that since it was past their 30 day service warranty they wouldn’t do anything with the car that THEY sold to me in that condition. She only offered to fix the tire and do the alignment at her car shop, almost 2 hours from me. She said since I got the brakes and rotors fixed elsewhere she will not reimburse me, but what was I supposed to do when nobody would answer me or give me information for almost 3 months??? I NEED a car to get around in. I just want my 700 dollars, the tire and alignment done, and to talk to someone ABOVE Sarah. I understand they can’t fix certain things but the car was sold to me like this and I have receipt proof.

      Hello,

I spoke with ****** on June 3rd, and she said she had been calling and calling since May 9th (not April). She then changed it to April once I explained that May 9th was outside of the 30-day warranty period. ******* said, "Well I started calling you in April." She told me she hasn't been able to get a hold of me (not sure why, I'm here 6 days a week from 9-5) and I explained that to her. She said "I have a life, I can't just keep calling, and keep calling" I explained to her all she needed to do was ask my employee the number to the service shop, and she would have been more than willing to give that to her so she could schedule a time to have the vehicle looked at. I then explained to her that we don't reimburse for outside mechanic work as we have our own mechanics (so no labor cost), and we get wholesale pricing on parts, and do not pay taxes. Shelbys response was " I live 2 hours away; I don't have time to drive down there."

After looking into this more after I received this complaint, I pulled her folder, and saw that the vehicle was actually sold AS-IS. She opted out of the warranty because she wanted the $11995 price. Please see the attached paperwork. Even though the vehicle was sold AS-IS, I still stand behind us replacing the tire (almost 3 months later & a lot could happen between that time) and doing the alignment. I explained to her all she just needed to reach out to our shop and give them the correct tire size so they can pre order it, and she can bring it here and we can replace that and do the alignment for her.

Please let me know if you need anything else from me.

[If you do not say why you are rejecting the company's response, BBB must close your complaint.]

      Complaint: 20139134

I am rejecting this response because: I told her I had received her voicemail on May 9th, which I have proof of. But I had been calling since before I got the car fixed. I can’t wait months to get my car fixed until she decides to answer the phone, I have a full time job and I’m a single mom. I cant function without a car. She was extremely rude on the phone and it was the most disgusting customer service I’ve EVER received. All I truly wanted was to talk to someone above “Sarah”. She claims there is not a general manager or owner? So apparently nobody owns the building. Makes so much sense. I told her I understood the car was sold as is, but it was quite literally sold with the wrong size and a piece missing. My family has bought all of our past vehicles from here, but not anymore. I will make sure to let everyone know this is how they treat their customers.

      Regards,

      ****** *******

Our car was shut off by the dealership after the monthly payment was made. The vehicle remained shut off for 7 days and as a result, was towed to a repair shop. Justin, the owner of the business, refused to reimburse us for work done to the vehicle or the cost to tow it, despite being the cause of the towing and repair. His actions are nothing short of criminal and his business license should be revoked. How can a dealership be allowed to shut off a purchased vehicle whenever they please, despite payments being made on that vehicle?

      Customer Answer

      Date: 01/06/2023

You have my permission to remove the part about shutting down the business and I was frustrated, though that is no excuse.

My vehicle was shut off by way of a kill switch controlled by the dealership. It is used to keep people who don't make their car payments from driving off with the vehicle. The issue I have is that the payments were made and up to date. The car remained shut off for a week and, because the payments were made, we towed the car to a shop for repairs. Had we been behind on payments, we would have contacted the dealership and not towed it to a shop and thus encrued the bills I attached to the original complaint (see attachments). If you have any more questions about the events or issues, please do not hesitate to contact me.

      Thank you,

***** is not our customer. I assume he is the boyfriend or family member of the customer. The customer has had her vehicle disabled previously due to non-payment and knows she must call in to have her vehicle enabled. It is in our buyer's contract that she signed. I have attached the part of the contract that details the device and how her vehicle may be disabled. ***** has changed his story so many times from saying an employee refused to take his payment, to saying another employee told him we were closed, and also saying he called to make a payment but got no answer. The vehicle was disabled due to non-payment.

***** is not part of this contract.
