            Advertising Review:
            On 11/16/2021, BBB wrote to the business concerning their guarantee on their website. BBB's Code of Advertising reads: "When using the term "guarantee” the advertiser should clearly and conspicuously include a statement that complete details of the guarantee can be seen prior to the sale by putting it on the seller’s website.", and "Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request."  The business did not respond to BBB’s request for modifications to their website.

            Government Action: BBB reports on known government actions involving business’ marketplace conduct:
            State of Ohio v Daryl Renard Allen, Bernard Crist, and Shane Michael Bates, individually and dba Good News Builders, and Columbus Deck Company LLC

            The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government’s allegations, which have not yet been proven.

             On Nov. 18, 2022, the Ohio Attorney General’s Office filed a civil lawsuit in Franklin County Common Pleas Court against defendants Daryl Renard Allen individually and dba Good News Builders, and Bernard Crist individually and dba Good News Builders, and Shane Michael Bates individually and dba Good News Builders, and Columbus Deck Company, LLC. They allegedly violated the Ohio Consumer Sales Practices Act and the Ohio Home Solicitation Sales Act.

            The Ohio Attorney General’s Office stated that homeowner complaints – one against Columbus Deck Co. and 11 against Good News Builders -  detailed financial losses totaling $132,139.80, and alleged that defendants failed to deliver promised goods and services, or performed shoddy work and failed to correct it. Daryl Allen was previously in trouble with the Attorney General’s Office for shoddy home-improvement work, and had been prohibited from doing business, and had a history of setting up a new company after consumers complained,  and Allen is currently accused of teaming up with Bernard Crist and Shane Bates, through two companies they operated – Good News Builders and Columbus Deck Co. LLC, related to the current lawsuit, according to the state. 

            The lawsuit is seeking an order requiring the defendants to reimburse customers and pay civil penalties and court costs. It also requests an order preventing the defendants from engaging in business as a supplier in any consumer transactions in Ohio until those debts are paid.    

            The matter is pending before the court, with a trial assignment of 12/18/23, according to the information we have at this time.

              We signed our agreement 7/5/2020 and paid $4,589.66. After a month, the company began digging holes. Progress was slow. We were told that the deck would be completed two weeks after the second payment of $4,589.66 (at commencement of work) September 26, 2020. The holes stayed unfilled until the spring of 2021. These created a hazard for children in the area. We called many times and left messages when we didn’t connect; they kept promising that they would come, usually within a week. In the summer of 2021, the company installed the posts. According to one of the company employees, the job was done incorrectly and needed to be redone. In the fall of 2021, the company completed some partial work and left materials on the ground. Exposed nails and miscellaneous construction materials are still there. There has been no progress in 2022, even though we have been in regular contact and are always given a work date within a week or so that is never honored. The neighbors have been very patient during this time. They recently expressed concern that the construction materials are degrading the neighborhood. Throughout this time, **** ***** and ******* ***** were our contacts. We were informed that Mr. B**** had a bad accident and could not work. We understood the situation. Later on, Mr. B**** cited COVID as the reason many workers were unavailable. We support small business but this situation cannot continue indefinitely. Our deck is still unfinished and unsafe. We request a full refund due to the inconvenience and potential liability due to the construction materials and, earlier, the holes. We have been unable to use our back door for more than two years as the steps have been removed and the deck is incomplete. There are also no steps from the unfinished deck to the ground and the boards on the deck are not fastened securely. We would appreciate anything you could do to help in this situation.

              I am writing in regards to a fence this company promised to place in May. There have been delays after delays. When they finally started the project, I gave a secondary deposit, and they would only complete bits and pieces for a couple of hours. We are going on four weeks since they started this project. Initially, ************** would respond to my messages, and now when I attempt to contact them, I do not receive a callback. This experience has been terrible. We are left with some wood posts in the ground. We have other holes with no wood post and are posing a hazard. Someone can accidentally fall in the holes and hurt themselves. If the job does not get completed, I am requesting a total refund. The contract was for a completed fence.
