      I purchased a ****** ****** tractor for $56,000 from this company.

      The value was determined based on the mechanical report that was provided the company.

      The tractors been delivered and has a major issue in that is has no brakes whatsoever.

      This is a major and very costly repair. The entire rear axle must be removed the tractor cab jacked up and brand new wet disc brakes installed after draining all the hydraulic fluid. It is thousands of dollars of costly repair not disclosed on the report of the machine I do not believe the seller was intentionally trying to defraud, but what I asked. but when I asked if it was in a flood, I was told no now the mechanic has found sand in the engine and found the fuel system has been replaced indicating that it was in a flood.

      The machine simply isn’t worth $56,000 and its current condition, and I would like to return the machine and receive a refund.

      I did not agree to buy this machine in an “ as is where condition in” condition, nor did I sign any statement to that effect there is nothing on any of the invoice that I had received from this company

      I bought this machine in good faith, depending solely upon the report that the seller provided

      there was no mention of either of these two things, that there was no brakes functioning on the tractor, ( that the tractor was in a flood previously ) in that report.

      I am a bee farmer, and I use the tractor every single day to move round bales, and feed my herd of black ***** cattle.

      If this tractor is worth what they feel is worth, they will have no problem reselling this machine in this market. I will gladly accept my refund and purchase a tractor from the local dealer. At this point please encourage the seller to do the right thing and process a refund for my $56,000. Thank you for your help.

      6/14/23 ******* ******* contacted our office inquiring about Asset IQ tractors for sale.  Information was sent on (12) ****** tractors.

      8/28/23 ******* did inquire about a 2*** ****** ** ******** which was located in ******* whether it was in a flood. I responded that this tractor was pickup in Illinois and I was not informed that this unit was in any flood or in water.  This was not the tractor *** ******* purchased. This maybe a confusion on his part.  Email attached (Aug. 28th).

      6/14-9/13/23 Several emails were exchanged regarding different tractors but *** ******* agreed to purchase a ****** ** ******** for $56K including delivery with no warranty, as is.  Emails attached (Sept 18th 7:03 p.m., Sept 18th 9:23 a.m., Sept 14th 3:37 p.m.)

      9/14/23 Invoice sent as attached.

      9/20/23 Received payment from *** ******* by wire transfer.

      Summary:  Asset IQ had the ** ****** ******** inspection completed by a professional which has been doing business over 30 years (brake inspection attached).  *** ******* was offered to view the tractor before purchasing and was aware this tractor was located in ******* (Email attached). *** ******* was never offered any warranty and all items were purchased as is where is with no refunds (Email attached). *** ******* accepted the ** ****** tractor on 9/26/23 (BOL attached). All communication was clear and no refund will be offered.

      “It was in flood water at one point.   The main transmission drain plug had been out of it in the past all the other plugs hadn't been touched.    There are about 5 plugs under there just to drain the transmission.     


      Had water in the oil.   The lowest point was the housing for the front wheel drive and probably a quart and a half of water came out before the oil did 


      It's had a fuel pump, fuel solenoid, and fuel rail put on it since new.   


      Do you know what the last owner used this tractor for?


      Finding sand around where the starter is and they couldn't clean it good.   It was in a flood somewhere”

      Does NOT mention tractor was flood water. The local mechanic just drains 1 and a half quarts of water from the front axle. It costly to complete the seal install on the front axle.


      Also waiting on the cost of the installing of wet brakes which requires removing the rear axle after removing the entire cab. Also costl, waiting on total amount of estimate.


      This is not honest business…please make full refund.

      I asked specifically is the tractor I was buying was in flood and was told no that by Cynthia that is was not in a flood.


      As far at the brakes, I will email what the diesel mechanic says as he is doing the repair an found the water in the front axle thus far.


      When I first drove the machine there no brakes..just a very loud metal on metal sound. I took a video of it and will send the video so you can hear the sound. This is a very expensive repair.


      Aft6er I made the wire it took a few days for the hauler to contact me. I took a good look at the photos and saw fluid on the ground underneath the from tire. At this time I asked a for a refund. This was before the tractor had been been loaded or moved. The seller chose to ignore my request. This upcoming costly litiigation could had been prevented if the seller has done the right thing thing at this point of my first request to terminate this transaction a wire back funds. The puddle of fluid turned out to be bead seal on the front end wheel.


      The bad brakes was NOT on the mechanics report. The bad brakes was not disclosed and were discovered by me. This is not funny. I am a beef farmer were profit margins are razor thin. I cannot readily recover from this $56,000 intending to defraud suit without full recompense.


      Bad brakes are not hard to diagnose. In this case you needed only to apply the brakes and a very loud metal and metal sound would alarm and the tractor continues to drive…it does NOT stop..very dangerous.


      I do not believe this was an oversight even by a modest mechanic….ia court may find the this under reporting or lack of reporting suggests that this tractor may not even been inspected by a certified mechanic supporting intention to defraud

      In the above email, I was told that they had no knowledge if the tractor was in a flood.  Now they the seller argues that it was not in flood.  Which is it? They either have no knowledge if it was in a flood OR they know that it was not in a flood. It cannot be both.  I was told it was not in a flood otherwise I would not have bought it. I would have bought a different tractor.  The diesel mechanic is certain that it was in a flood based on his findings.


      He also found the brakes to not functioning as they should. I hope to upload the video where you can hear the brakes screeching.  I am willing to pay return shipping if I receive the full $56,000 returned to me.  Or if the seller wires fund to cover the $12,000 repairs, I will keep the machine and have it repaired. I prefer to simply buy another tractor from a reputable dealer.

      My mechanic told that this machine was definitely in water of some water.


      I will email his text messages to substantiate this.


      I was told by the company that is was NEVER in water.  


      They sold me a $56,000 tractor that has no brakes and that I cannot safely drive.


      When I questioned the seller about the puddle of fluid shown in the photos and asked to terminate the sale and requesting a refund, the seller choose not to respond for a few days until the tractor was 6 hours away from my farm.  It was all kind of shady.


      How can I send a large video file of the screeching noise from this tractor as the file is too large to email?

      1. I have had this tractor for 2 months and this is unresolved. I wish to return this machine for a full refund of $56,000. Please provide the address to have this shipped. 

      2. According the diesel mechanic The tractor has been in flood waters as the entire fuel system has been replaced and here are two different kinds of sand in the engine block.

      3. If the seller told me this machine was in a flood when I asked, I would not have bought it.

      4. If the seller cancelled the transaction BEFORE it was shipped, Like I had asked in my email after I saw in the photos a puddle of fluid leaking from the right side front axle,  we would not be in this mess where we both loose money.

      5. Seller states the tractor is from Big Iron but there is a sticker from Ritchie Brother's Auction with Lot # on it. Apparently the tractor could not be sold at the auction because it was in flood waters.

      6. Where can I email a large video file of the braking noice?

      “After looking at the mechanic estimate, I do not see
      any significant issues that should warrant a monetary reimbursement to the
      customer.

      The inspection report directly disclosed leaking axles with 2-star
      ratings that represent needed repair.

      The other expenses for filters (engine/trans/fuel/air) and fluid
      change are standard maintenance that any end user would be responsible
      for.

      Brakes are associated with consumable wear parts that are generally
      not covered.”

      What they said is not true whatsoever. They did not disclose that the machine had 2 bad seals nor did they disclose that the brakes were frozen up.
      For brakes to be frozen up on a three-year-old machine that only had 1200 hours on it is because the machine was in flood water.
      I have a 2009 tractor with 3600 hours and the brakes are flawless because it has never been in water.
      Again, the reason the bake breaks for frozen was because this machine was in a flood.  This is a major lack of transparency on th sellers Part.
      if they would have disclosed that  this machine had been in wate, r I would not have purchased it.
      that is the reason the brakes and the seals needed to be replaced.
      The mechanic, when he replaced the front right seal,  measured a quart of water that came out of the left front axle.
      They are not being honest.
      I'm not asking for reimbursement for anything.
      I want to return the machine and get the $56,000 wired back to my account.
      The seller intentionally attempted to defraud.
      When I had told the seller I wanted to terminate the transaction before the tractor had even been moved they went off the radar for 4 days.
      They did not respond because they knew that this tractor was not a good machine.
      if it is such a mechanically sound good machine as they are claiming,
      they will have no problem whatsoever selling it to another customer.
      I however, am not that customer.
      I have a working functioning farm and I need dependable machinery to feed cattle daily throughout the winter.
      This machine has been in a flood it has been in water and obviously is not mechanically sound.
      Please provide the address to which this machine will be delivered.
      The seller has another tractor that has NOT ever been in water **** ****** ********** with 894 hours serial # ***** that would settle the matter.
