    We got a verbal bid from Kenmore Painters (*** **********) to power wash, mortar and paint our storefront. We had established a verbal agreement as to the details of the work to be done, but I told *** that I wanted that agreement put in writting as a condition for the work to be done. He said he would provide one but didn't. He started power washing without providing the written agreement, so I told him again that I wanted a written agreement for the work to be done. He finished the power washing in about ten minutes and left. It was a light cleaning, and I was disappointed that he didn't do a longer and stronger washing. In the process, his assistant broke our exterior water spigot, and I had to hire a plumber to fix it. He did not offer reimbursement. He came out again and patched a couple of cracks with mortar and left immediately after, and again I told him that I wanted a written agreement. Another day he came out and started painting before I got to work. When I arrived, he handed me a slip of paper with almost no detail on it and claimed it was a written agreement. It had no signature, no legal statements that would indicate an agreement, and it did not accurately state the details that he and I had verbally agreed to. I told him it was not an agreement. Concerning the painting, he was supposed to have stated in writing that he would put on one coat of primer and two coats of paint. Instead he decided on his own to buy paint that has primer in it and use that instead of putting on a coat of primer. I told him that was not the deal. He claimed it was fine because of the quality of the paint. Because of the age and poor condition of the old paint that he was painting over, primer should have been used. After only a couple short trips to our property (each under 2 hours) to do painting, the first coat of paint was still not complete. He demanded $1,250. I told him that I only thought his work to date was worth $1,000, and he agreed to that amount. That amount did not include reimbursement for the water spigot and did not address that he had only used half of the purchased paint. As an incentive for him to complete the first coat, I paid him $1,250 provided he finish the first coat that day. In examining the cancelled check, he must have gone straight to the bank to cash the check after I gave it to him. He never came back to complete the first coat as he had just promised. I never heard from him again. I texted him repeatedly and received no response. He left our storefront in a shabby state. Because of his constant delays, time ran out with cold winter weather approaching. His delays have made completing the first coat doubtful. Our storefront may look shabby all winter long. We had agreed that for the power washing, mortar work and painting completed to date, he was only due $1,000, but he was paid $1,250 as an incentive for him to complete the first coat. He did not do that, so he owes a $250 refund. The $1,250 also did not subtract out reimbursement of $366.95 for the plumbing repair. He did not return the remaining paint, so he owes a $107.25 refund for the paint that we paid for that he kept. In total, we are due a refund of $724.20.
