This company entered my property to perform tree trimming for my neighbor. During that process, they also cut down a significant portion of my bushes surrounding my screened-in pool—bushes that were not located within any easement and had no reason to be disturbed. As a result, the landscaping around my pool is now severely damaged, and I have lost all privacy in my backyard.
Even the inspector from **** ****** confirmed that there was no justification for trimming or damaging my bushes. Despite this, the company has denied my claim to address or correct the damage they caused.Business Response

We take all complaints seriously and appreciate the opportunity to investigate this situation and provide the following information. On May 13, 2025, Lewis Tree Service (LTS) was contracted by **** ****** to clear vegetation surrounding an electoral pole at a property on **** Drive. As part of this project, LTS performed minor trimming of the shrubs and bushes referenced in the complaint. This trimming was necessary to safely access and complete the vegetation management work required by **** ******. These bushes are present on the property at ***** **** *****, which is adjacent to the complainant's residence. The bushes are growing alongside the screened-in pool that is on the property at ***** ******* *** *., owned by the complainant. (Please see map on Page 2.) Following the trimming, it is still quite difficult to see the building through the remaining bushes. (Please see pictures taken on 7/8 on page 2.) On June 10, 2025, an LTS employee spoke directly with the complainant to explain the reasons behind the trimming. It was communicated then that the shrubs/bushes had been selectively trimmed in a way that preserves their health and ensures they will regrow over time but also allowed the work to be completed. The employee also reassured the complainant that the remaining vegetation continues to provide the privacy that he seemed concerned with. At that time, he asked the complainant if there was anything we could do to further address his concern, but he did not offer a response. While we understand that it can be unsettling to have the natural environment disturbed surrounding your home, we are confident that our crew completed their work in an appropriate manner and did not disturb or damage any of the complainant's property as these bushes are part of the adjacent property. To Whom It May Concern, I am writing in response to the statement issued regarding the trimming of the bushes adjacent to my property at ***** ******* *** ** I must respectfully disagree with the assertions made by Lewis Tree Service (LTS) and wish to formally express my objection to the actions taken on or around May 13, 2025. First and foremost, the trimming of the bushes was entirely unnecessary. The vegetation in question was not located on any easement, nor was it obstructing access to the electrical pole or any utility infrastructure. These bushes were not only fully outside the work area, but also integral to the privacy of my home. It is worth noting that a separate tree removal company was subsequently contracted to remove the entire tree near the pole, and they explicitly stated that the bushes should not have been touched and were not interfering with access or safety in any way.LTS had no authority to enter my property or alter any vegetation growing on it. If, as LTS claims, the bushes are located on a neighboring parcel (***** **** *****), they had no right to enter my property at ***** ******* *** * to perform trimming work, nor did they obtain my consent to do so. If the bushes are, in fact, situated on my property — which appears to be the case based on their proximity to my screened-in pool — then LTS violated my property rights by altering landscaping without permission, which may constitute trespass and property damage under Florida law. Additionally, the claim that the remaining vegetation "continues to provide privacy" is demonstrably false. These bushes were the only source of privacy for my pool area, and the trimming has left it significantly exposed. The assertion that they were "selectively trimmed" to allow for regrowth does not negate the fact that it will take years for the vegetation to return to its original density — if it ever does. The excuse that "they will grow back" is insufficient and unacceptable, particularly when no authorization was given to touch them in the first place. LTS's employee did speak with me after the fact, but the trimming had already been done without my knowledge or consent. I was not presented with any viable solution, and my concern about the loss of privacy was met with dismissal. The suggestion that no further action was requested at the time does not relieve LTS of responsibility for the damage they caused. Given the above, I respectfully request one of the following remedies: Replacement of the bushes with similar species of the same size and density; or Financial compensation equivalent to the value of restoring the landscaping and lost privacy. If this matter is not resolved satisfactorily, I may be compelled to seek legal counsel to explore potential claims, including but not limited to: Trespassing Unlawful property damage Loss of use and enjoyment of property Violation of Florida’s landscape protection statutes, where applicable I expect a timely and good-faith resolution to this issue. Please consider this a formal request for remediation. If necessary, I am prepared to pursue this matter further through appropriate legal channels.

I’ve had two landscaping companies visit the property to assess the hedges, but unfortunately, neither has followed through with providing a quote. At this point, I would greatly appreciate it if someone from your team could come out to the site and provide a clear, written estimate for the removal and replacement of the existing hedges, including installation. From there, we can discuss the next steps. I'm unsure why it would be difficult for your company to provide a quote for a fairly straightforward project, and I hope we can move forward more efficiently.Customer Answer

Lewis Services understands the concern and empathizes with the property owner. However, investigation revealed Lewis Services did not cause the property damage. A Massachusetts State Police Officer indicated the damage was not caused by Lewis as he accompanied the crew in front of the location on a traffic safety detail.Initial Complaint

On Sept 8th 2023 Lewis tree service a subcontractor for ******* ***** * *****, used my back neighbors property to get access to my back yard. With out permit ion they pulled the truck in to trim the branches from my avocado tree that they said it was to close to the transformer. The person on the bucket truck just cut the branches and let them fall , bringing down **** cables and my alarm cables . I was 4 days of no alarm, internet or cable .The branches damaged my chain link fence , a 2x4 for a metal roof, that same night it rained and found that the roof of my work shop was damaged , a new cordless drill the case was full of water and water was dripping down the walls .I provided Lewis pictures of all the damages and estimates to fixe the problem, pictures of my shop roof that's under the trees . All damages for $ 5000, I was referred to Carolyn T***** (Risk Management) provided her pictures of drill, fence, 2x4, shop roof ,**** cables and an explanation of what happened , a few days later received an email from Carolyn stating that per her investigation Lewis was not responsible for the damages, she had pictures of branches and avocados on the roof , of course what happens when you cut branches and they fall , she provided a picture of my neighbors shop roof not mine . I contacted her right away (via phone ) told her that the picture she send me was not my shops roof , that it was my neighbors . .She offered $150 to make this problem go away. I find the amount offered will only cover the cost for the fence .Customer Answer
