David H******* is a contractor that I hired to complete renovations at my home last year. However, due to his unethical tactics and lack of integrity, I fired him. Out of retaliation, he submitted a petition to Monroe County Supreme Court asserting that I owe him $30,162 and is asking the court to place a mechanics lien against my property. There is a signed contract between Mr. H******* and me for $28,897, which would be paid through the ****** Remodel NY grant upon completion of his work. One of the itemized costs in the signed contract is $4,300 for insulating my attic. I would not have objected to the $4,300 when the final draw request was made had another contractor not have to come behind Mr. H******* and complete the work he was paid to do. Because Mr. H******* is skilled at cutting corners, he thought that he could get away with putting just enough of the fiber glass insulation on the surface to pass inspection with the HUD inspector. He would have gotten away with it if a separate inspection from another grant had not revealed that the cavities were practically empty. Another company had to come behind Mr. H******* and blow insulation into my attic where it took them almost (3) days to complete the task. The final scope of work given to me proved that Mr. H*******, indeed, had not performed $4,300 worth of work as he claimed. He is trying to get away with fraud and is trying to push my house into foreclosure because I refuse to help him do so. In addition to that, he is posing as a minority contractor when he, in fact, is the opposite. His letter head lists Tomeka N. Haynes as the contractor; however, throughout the entire time he was on the project, I never met her. In fact, when I asked his workers about Tomeka N. Haynes, nobody knew who she was. One might argue that David C. H******* has, fraudulently, acquired minority contracts from bids he placed as a white privileged male. I don’t know how many other victims Mr. H******* has bamboozled, but I refuse to be a victim and hope, through my experience, that he doesn’t get the opportunity to victimize anyone else. Mr. H******* used intimidation as an attempt to coerce me into helping him carry out fraud. Almost a year later, he refuses to let the nonsense go.
