    On Monday, March 3rd, 2025, at approximately 9:30 AM, the company in question was cutting down a large pine tree on the south side of ***********************************. The employee operating the chainsaw was carelessly dropping branches onto the bushes at ****************************************************************. Multiple attempts by the owner of the bushes to contact the company and reach a resolution were ignored. Tree companies are responsible for any damage caused by their employees to neighboring properties. The owner of the bushes is requesting compensation for the damage caused by the tree company.

    3/3/25           Received a call from neighbor & spoke with secretary, ******.          
    3/6/25           Letter received from BBB
    3/6/25           A call was made to neighbor & left a voicemail message.
    3/6/25           Neighbor returned call & spoke with manager, ****** *******.
                        Neighbor was told that our NYS licensed & certified arborist is away but will be available on 3/8/25.
    3/6/25           Neighbor agreed to appointment
    3/8/25           Our arborist, **** ***** met with neighbor, *********** ******.

    Findings:     Will be taken care of mid spring when weather is milder to avoid freezing of any new growth from fertilization.
    The damage to the boxwoods is all white and insect damaged which has nothing to do with the limbs that were brushed against the boxwoods.
    *** ****** & our arborist **** ***** came to an agreement that we will feed the whole row of his boxwood shrubs not just the ones in question, that were not damaged by the removed pine tree limbs.
    *** ******, also asked about other shrubs on his property of which **** advised him on.  If any further information is needed, please contact our employee directly 
    NYS certified arborist, **** *****, license #******* @ ************.

    We have copied *** ****** (neighbor), **** ***** (arborist), and ***** ***** (*******) on this email.

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    I have carefully reviewed the response provided by the business in reference to complaint ID# ********, and I have determined that my complaint has not been resolved for the following reasons:

    The companys response inaccurately describes the nature of the complaint. Specifically, they state:
    "The damage to the boxwoods is all white and insect-damaged, which has nothing to do with the limbs that were brushed against the boxwoods."

    However, on March 8, 2025, Arborist **** ***** and ***** ****** visited the property, and during this meeting, **** ***** acknowledged that the damage to the boxwoods was caused by the companys failure to properly rope off the limbs of the pine tree during the removal process. This is the core issue of the complaint.

    To resolve the matter, I request that the agreed-upon feeding of the entire row of boxwoods be scheduled and completed. Once this is done, I will consider the issue resolved.
