      I confirmed a size of the shed for my backyard. My backyard has a slope, so the shed would need some type of footing. *********** gave me a verbal price of approximately $3000 and would come to the house to do a site survey to give me a firm estimate Once that the survey was complete, the price for the footing was $6000 that made the price of the job way out of my price range. I asked *********** to refund me the money instead he said that he had ordered the shed already and could not give me, the money back $4500 He then offered to sell the shed. Once it sells, he would give me my money back. It has been approximately 8 months and he still has not sold the shed and is holy my deposit.I dont feel he should have ordered the item without completing the survey and providing a firm price he is holding up what is a lot of money for me

      This is in response to the complaint sent from ***********************,ID ********. **************** came into our shop in October 2022 to inquire about a shed. He had decided on a customer style shed and asked us about site work. He said he was out about 9 and wanted to know an approximate price. Without going  out to the site we gave him an approximate price of $3,000.00.
      **************** came back the following week and purchased a 12x 16 *********** style shed. (He upgraded from a standard wood A-Frame to a *********** A-Frame and added an additional door with a specific location for the doors. This made it custom.) He asked us then if we would come out and do a site visit for him. We went out and strung out the site for him and the site was 25 out not 9.  The quote to do a retaining wall and fill for that area was $6200.00.  The site was more than double the amount he said he was out of grade. **************** was not home but his wife was. We suggested another area for the shed. She said she would let him know. A couple of days later we were notified that they were going on vacation and that he had marked out a new site where he wanted us to check. When the weather allowed us to,we went back out and the new site was one inch different than the previous one,24 out instead of 25. The price to do sitework would be the same, $6200.00.
      **************** said it was more than he wanted to spend. We suggested he could call a landscaper and see if they came in at a better price. We did not hear back from **************** for a while. Until he contacted us asking for his deposit back. I had informed him that I would call the manufacturer and if they did not make the shed there should be no problem but if the shed was made it would not be refundable because it was a custom unit. The manufacturer said that the shed was already made and was due to be delivered the following week. I explained that he could choose a different location for the shed, or I could try and sell it and once it sells, I would reimburse him his deposit. He was not pleased but understood at least I thought he did until recently.
      I received an email from **************** on December 1st asking if I still had the shed and if I did, he would like it if I could do the site work for $6000.00 even. I emailed him back and asked him to call the office so we could set up a date. Never heard back until I got a text asking if I still had the shed, again I informed him that I did and had it up for sale on the lot and there is not much action in the winter. Hopefully, spring will be better. This brings us up to date. The shed is still on the lot up for sale.
      It is our policy as I stated above that custom orders are not refundable. I feel we have been very accommodating by trying to sell his shed. When that shed was delivered to the lot, we had to pay for it in full and pay the sales tax for it too. Believe me when I say I want to sell that shed too. I am out more than **************** and am now getting bad press from **************** that is not justified. *** **** has been in business for 28 years and we have a good reputation because we do the right thing. We went out to **************** house twice without charge and we usually require 50% down and we accepted less. We care about our customers and feel this complaint is unjust. We will be happy to refund **************** when the shed sells or will deliver it to him when he pays in full. If needed, I can provide you with documentation of our exchanges to support the above statements that Ive made at your request. Thank you.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

       When I started working with *** **** I was seeking to purchase and have a shed installed on my property; one total job.

      He then showed me a catalog of readily available models. All I had to do was pick my color, door location and trim color.  Nothing on the sale receipt stated I was ordering a custom one-of-a-kind shed.
      Next I was then shown platforms by which he used to set the structure onto the property. (Ive enclosed pictures of his catalogue below.)

      He explained that this platform will cost no more than $3,00.00 to $3,500.00.

      I asked him if he had insurance documents, and workmen comp papers for his workers and he does.  I provided those to you in my previous correspondence.

      He then explained that he would go to the house so that he could do a survey to give me a firm price on the work.  He was delayed due to weather.

      He wanted a good faith deposit from me to start this job which is when I gave him the $4500.00.

      Nothing in the receipt stated that the shed would be delivered at a specific date or that the work would begin at a specific time.

      *** **** took it upon himself to finalize the build of the shed without confirming to me the final price for the complete job.

      When he gave me the final price for the platform, it was double the initial quote.  It was $6200.00 instead of $3000.00 to $3500.00 dollars.  Plus I still had to pay for the shed which cost $10,098.88.  That put the total job at over $16,000.00 which is way above what I can afford.  

      I told him I could not continue with the job and I asked for my deposit back.  He refused and said that the shed was already ordered.  I told him I was never given a firm/final  price on the job. 
      I never approved the delivery of the shed .  
      He refused to return my deposit of $4500 dollars.  He then said that he would sell the shed and then refund my deposit.

      Ive patiently waited for months but so far this has not taken place. 

      *** **** still has an item that he can sell at any of his locations, yet refuses to give back the deposit for work I never approved.

      Ive tried to work with him, to avoid any court proceedings but Im still waiting for a refund.

      *** **** claims to have a reputable and big business.  If that is the case, he should be able to sell that product anywhere within his jurisdiction. 

      In closing, I would like for him to refund the monies and have this issue resolved .

      **************** signed both the invoice and work order and left a deposit which starts the process of making the shed. We also supplied him with the insurance he needed so he could go to the town and get the permit. He wanted the shed in a timely fashion and that is what we did. We will gladly refund his deposit once the shed is delivered or sold. We have signs in the office stating our policy and as I stated in the previous letter he was also told of our policy. As of now **************** owes us $5598.88. *** **** has been extending a curtesy by leaving his shed here and trying to sell it for him. We charge a daily fee of $3.50 for sheds that are here for ************************************************************* He notified us that he wanted to cancel the shed  after it was already made. Thank you. I have attached the signed invoice, work order and policy.
