      Hello, I am ******** *******, I am 84 years old and I used to live at *********************************************************************************************** where I had a residential elevator. I used the services of All Ways Elevator to maintain and do security checks of the elevator. I called All Ways Elevator and informed them that I would be selling my condominium at ********************************, and did not want to have a five-year contract. I was advised by **** ******* that they only do contracts of five years and that I would be reimbursed the money for the service left unused on the contract. I paid $2,987.19 by check, check #*** from my ******** account and sent it on April 12, 2023. The check was cashed by All Ways Elevator. After I closed on my condominium on October 11, 2024, I called All Ways Elevator to request the reimbursement for time unused on the contract. I have called several times, left messages for the CEO and have never received a call back. Please help me. I do not want the entire amount, only what is fair, the contract was only used for 18 months--from April 12, 2023 until October 11, 2024. Thank you

      Please note we have been in business for nearly twenty years and have never had any complaints filed against our company. We are very transparent about all the work we do and communicate this clearly to all our clients.

       

      Attached please find the signed agreement and a copy of the most recent paid invoice. 

      This initial contract goes back to February 2013 and was never escalated as a professional courtesy to the client.

       

      Unfortunately, as I explained to **** ******** daughter, who is the one that filed this complaint, there is no refund that we can offer them.  There was also no verbal statement made to ******** about being able to get a refund, as that is not our company policy and not per the contract.  Had they desired to change their contract they would have had to do so at the renewal time.  The pricing for longer term contracts is substantially reduced and as such are not cancellable during any portion of the term.  Much like a lease on a car you agree to the price for the term.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      All Ways Elevator ignored repeated attempts by the New York State Division of Consumer Affairs and then the Better Business Bureau, until now, months after the initial complaints were made. The conversation I had (in the presence of my mother, while she was in the hospital, after falling at church and breaking her hip on 2 April 2023) with All Ways Elevator took place on 12 April 2023. At that time, it was stated that she would receive a reimbursement for the unused portion of the service contract after we asked if the contract could be for a shorter period of time since she was planning on selling the condominium. I have spoken with my cellular phone carrier to find out if it's at all possible to retrieve the conversation from 12 April 2023. I am awaiting their response and have now contacted my ************************************ (**** *******) for further guidance. They reached out to All Ways Elevator and did have a conversation with someone, and were also told that no reimbursement would be given. I am acting on my mother's wishes to try to obtain any refund possible for the unused time. She now resides at ************, an assisted living facility in ****************. She was issued prorated reimbursements from all other service contracts, i.e., the alarm system, appliances, etcetera. She is only asking for a fair reimbursement and instead of receiving any response, the calls were ignored. This claim is not satisfied and I will continue to pursue this matter under the guidance of our *** Assemblyperson. I apologize for the notes taken on the bill--as I was speaking on the phone I was taking notes and writing down the dates of the final elevator inspections before the closing of my mother's condominium took place on 11 October 2024.  To the employees of the Better Business Bureau, thank you for your time and assistance in this matter but it is not resolved.
