Last April I moved into ** ******** *** ***** I had to clean the apartment so I could move in I had to debug the apartment from roaches I had to clean the basement of human feces and animal feces I had to clean the backyard of debris and the garage of all of the previous tenants things. I had to deal with false accusations and harassment by the property manager Mrs. Dickey she stole my security deposit won’t return it she also cut off the water and gas to my apartment it would not turn them back on or allow the gas company and I had to call off work to allow them in to turn back on she terminated my lease under false pretenses and she terminated me under false pretenses she slandered my name calling me a pedophile among a bunch of other slanderous names and accusations. She openly admitted to not fixing anything especially the foundation issues which the building inspector Jason wanted to condemn the property over. Hasn’t fixed any of the water leaks on the electrical she hasn’t pulled any of the fire wire or the random wires that are just Loosely about.

      Business Response

      Date: 06/13/2025

I respond to this complaint saddened that this individual has refused to go on with his life and chooses to waste time based on his actions. I rented ** ********* to Mr. ******* in April of 2024. This is basically the only thing he said that was true. I had empathy for Mr. ******* because he was relocating to Buffalo from what sounded like a messy divorce. Firstly, we would never have moved him in a house nor would he accept a house with animal or human feces. If that were true (and it's not) why did he not bring this to our attention. Clearly, that's unsanitary, I would have NOT moved him in under those conditions. Several months after moving into the house, there was a sewage back up - no fault of the owner, however, it was the owner's responsibility to fix the problem. We had a licensed plumber (***** Plumbing) to snake and sanitize basement. We have the plumbing receipts to prove the basement was snaked. As far as roaches are concerned, that may have been true, however, while work was being done, we never saw traces of roaches. That should have been brought to our attention as well. As far as the utilities are concerned, there is no way I can have gas turned off when it's not in my name so clearly that is not true. I cannot as a property manager/landlord turn water off. A house is not livable without water. He is not telling the truth that he had water cut back on because it's not in his name, it's in the owner's name. He should present evidence that Dickey's Properties had those two utilities cut off. If you don't tell the truth once, your statements are discredited because we don't know when you are telling the truth or exaggerating. This all began when he made the decision to date the lower tenant who lived there prior to Mr. ******* coming on board. The tenant got pregnant and then lost the baby. Things didn't go well, so both tenants involved me in their personal affairs because it did not work out. I received multiple text messages from her stating he was crazy, and she was afraid for her and her child. To be honest, when he doesn't get his way, he can go from a scale of 1 to 1000 which could be intimidating to a young woman. I experienced his disrespect and name calling. I requested that they both were adults and should leave me out of their personal affairs. It escalated to the point where the lower tenants put in her notice to move. At that time the owner requested that I move Mr. ******* out since he was the problem and that he may do it again. I told the landlord the lower tenant voluntarily requested to move so let's go with that. (Big mistake on my part.) The house was rented again to a young lady with her child and her mother. Three days in, I received a call from the new lower tenant at 10 p.m. questioning me about Mr. Mathews. (things like what's wrong with him) After only 3 days she was saying the same thing - "I am afraid for me and my child." After a second call from this new tenant regarding her concerns, I decided that Mr. ******* had to go. He was on a month-to-month lease just shy of a year so legally we only needed to give 30-day notice. We gave him 60 days since it was during the winter months to find other suitable housing. What Mr. ******* did not understand was we could not afford to keep renting the house when he seemed to be the common denominator. He was not happy and in less than 2 weeks, I received 19 repair requests from Mr. ******* from our door-loop platform, the same system he could have used during his tenancy there. I know it was out of spite, and I told him we would address the issues, however, he would not be there to enjoy it. Soon after, I received a notice from City regarding violations none of which stated human or animal feces. We have since completed all the violations except structural in the basement but have been given the green light to rent again. We were preparing for court if Mr. ******* refused to leave on the expiration date which was February 28, 2025. Mr. ******* contacted me and stated that because he didn't have gas or water, it delayed his move out (I'm not sure how or why) and he requested to be out by March 7th, which I agreed. I text him on March 7th confirming our final walkthrough, stating that I did not hear from him and should I assume that he had moved out? Nothing? I came to the office on Monday the 10th and the keys to 57 Humphreys were left in our mailbox with no label or note. We went to the house after 4 p.m. and it was clear that he was gone. He decided not to meet for a final walkthrough. We took pictures of a small hole in the bedroom wall that required pasting, sanding and painting, also trash that he swept up in the yard and left, so we were also cited by the city. I received notice from him that he was taking me to court for $5,000 and the return of his security deposit in which I was keeping from him. I told Mr. ******* on April 15th that I would be more than happy to return his deposit, minus the extra time he stayed, the hole in the wall and the pile of debris that was left. He texts back on the 18th to say he will pick up his security deposit on that Friday. He came to the office, opened the envelope, read the letter, looked at the check, left it and walked out. This is what I was told by my assistant. He sent a text stating that he has everything on video because he lives for video recording and that was another complaint of both tenants feeling uncomfortable that he had cameras everywhere in which I should take the blame for approving it. In my closing, from the beginning I gave Mr. ******* a place to live in good faith and it didn't work out. I did not evict him, so nothing is on his record, I simply requested that he move and gave him ample time to do so and that made him angry. He is currently suing us in small claims court for $5,000 not knowing in a court of law, you will need to prove what you are saying for it to be true. Now I see what the first tenant went through when he had her back and forth in court. Our intent, even in the end, was never ill will towards him. We did everything according to the law. I really believe Mr. ******* needs to see someone professionally because there seems to be some deep-rooted issues that need to be addressed. I never slandered his name, and the word pedophile never came out of my mouth. He has mistaken me with someone else. I never once slandered his name. Whatever I needed to say about him I told him to his face because like the others, I was NOT afraid of him. Not once did Jason, the inspector, ever say the house needed to be condemned that is completely false. Like I said, the city has given the ok to rent it again. Prior to my last inspection with Jason, he inquired, and these were his words 'Is that tenant still there?" I didn't have to ask but I knew he was overbearing with the inspector as well. All my years of real estate, we have never received such a complaint, but he told me that he would try to have my license taken. I really feel sorry for him and hope he closes this chapter and gets on with his life. Sorry for the rambling. If you need additional information, please do not hesitate to contact me.
