I do not accept documents via email. I will only receive proper documentation via certified mail. Thanks for your understanding.

    Dear Better Business Bureau,

Please accept our apologies for the delayed response. Unfortunately, the initial communication from the BBB was not received by DMP, which caused the delay.
DMP acquired Mr. ******** account from Loan Me in June 2019. Due to a clerical error, the account was closed and has not been subject to any collection activity since December 21, 2020. Given the age of the account and its inactive status, DMP has decided to keep the loan permanently closed.

We were surprised to receive a complaint regarding an account that has been inactive for over four and a half years. If there are any additional concerns or elements to this situation that we may have overlooked, I encourage you to reach out to me directly so we can address them promptly. Please note that DMP does not report to the credit bureaus.

Regarding the contract, we are happy to provide a copy to the customer via email. While the law does not require us to send it via certified mail, we would like to clarify that, given the account’s closed status, providing the contract at this stage may not serve any practical purpose.

    Sincerely,
    Chris A******

*** check cashing was paid $281.75 threw my bankruptcy in 2020 *** said they sold my info to debt management partners, debt management partners says they sold it to ******** ****, ******** **** says they don't have it, is this y I'm seeing unrecognized items on my credit report? *** needs to close my account so when I do business with another company it doesn't show a open loan with *** check cashing.

    Business Response

    Date: 01/22/2025

The facts I have according to our notes and records:

    • The customer obtained a loan from *** Cash Express on 10/10/2019.

    • *** sold the delinquent loan with a balance of $281.75 to my company, Debt Management Partners (DMP), on 02/27/2020.

    • DMP sold the loan to ******** **** Management LLC on 12/29/2021. I’m not sure why ******** **** Management states they do not have the loan; my follow-up emails to them have gone unanswered in an attempt to seek clarification.

    • Since 2019, ********* ****** has filed for bankruptcy four times, with each case resulting in a dismissal. (See attached documentation.)

    • According to *****, *** was not listed as a creditor on any of the four bankruptcy filings.

    • According to *** Cash Express, they never received any payment from the customer through bankruptcy proceedings to close out the loan. It’s important to note that all bankruptcies resulted in a dismissed status, and a Chapter 13 bankruptcy typically requires consumers to pay a percentage of their debt, not necessarily the full balance.

Ms. ******’s requested solution is for *** to clear the debt so she can obtain new loans:

    • I am unsure why there is a BBB complaint against DMP if the customer disagrees with ***’s underwriting policies.

    • If *** is incorrect and a payment was indeed made to them, please forward me a copy of the payment confirmation. I will work with *** on Ms. ******’s behalf to rectify the situation.

Lastly, there seems to be a general misconception regarding the impact of bankruptcy filings on debts:

    • A bankruptcy that is discharged—not dismissed, as in Ms. ******’s case—removes the debtor’s personal liability to repay the balance. This effectively changes the debt’s status to “closed.”

    • However, a discharge does not erase the record of the debt itself. ***, for example, does not report to credit bureaus, but they are within their rights to decline new loans to customers who have had prior loans included in a bankruptcy.

    • Again, DMP has no influence or authority regarding ***’s underwriting and approval decisions.

I hope this clarifies the situation. Please let me know if any additional details are needed.

    Thank you,

    Chris A******

Hi,The account we have in our system is an *** **** ******* Account from 2013 account number *************.  I am not sure what that file number is that you are referring to. Back in 2015 we had sold to ******* **********, and they are no longer around.Second any company that is legit would not be calling you now since it is over a decade ago and past the statute of limitations for collecting.  If you are receiving calls, it is most likely a scam and i would ignore the call.  Your original balance was only $314.98 and company's we sell to don't raise the balance.  If someone continues to call you just tell them, you called *** and you have a zero balance.Thank you

Debt Management is not a collection agency.  We are a passive debt buyer and we have never purchased a ****** ***** *** loan account number *****.

    Customer Answer

    Date: 06/22/2023

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.  Because i have check with Ms. ******* ****** regarding the issue that ****** **** *** has lied about when they said they has sold their Loan account  to Debt management and to call ************** and spoken with her and she  veryify and search her record and found out that  they never purchase ****** **** ***  Loan account that ****** **** *** has lied about when they has received the Notice of Chapter 7 Bankruptcy notice letting them know their account  is in chapter 7 bankruptcy case filing so they cannot sell their account to any Debt collection agency to collect and debt of.
