To Whom It May ********* had an evaluation and treatment at Bensonhurst Dental Care on 4/3/2023, 4/12/2023 and 6/12/2023. I had paid $8850 on 6/12/2023 as an advance for future treatment of one tooth that was supposed to be performed on 6/21/2023. I called and cancelled the appointment on 6/16/2023. On 6/23/2023, I visited the office to ask for a full refund of $8850. I wanted to handle this issue without any trouble for either of us but was told they would not provide a full refund and will charge me for biomaterials that are not custom made. I was told that they are not ready to make a refund and will contact me at a later date with the exact amount, despite the fact on 6/12/2023 they had calculated everything and charged me $8850 to my credit card.On 7/5/2023, I received an email asking me to sign a refusal treatment form. According to it, they were ready to refund $6050 and keep $2800 for a service which was not performed and biomaterials that were never used. I didn't sign this form and instead sent an email to Bensonhurst Dental Care to ask for a full refund. They then called and in the call, refused to give me the full refund.Business Response

To whom it may concern,
On April 3, 2023, the Claimant paid a total of $1,681.00 in full for services. A secondary appointment for additional services was scheduled for June 12, 2023.
Claimant was advised of the cost, and signed the paperwork detailing the itemized cost.As such on June 12, 2023, Claimant consented to pay a total of $8,850.00. A disclaimer on the bottom of both the plan and the credit card authorization stated, all fees paid in connection with patient's treatmentare non-refundable.
Despite this, on June 16, 2023, the claimant communicated he wanted a refund.
About a week later, the Claimant came to our office to formally cancel the procedure.As per office policy, the claimant was given a Refusal to Consent to Treatment and General Release to sign on June 23, 2023. The release offered a refund of $6,050.00 for the work that had not yet been done and/or ordered. The Claimant refused to accept the refund. Due to the nature of the procedure that was to be performed, the services already provided, and the custom materials that were prepared, these materials cannot be reused for another patient and our office would have to discard them. Therefore, our office is unable to refund the total amount that the claimant has requested.Customer Answer

On June 16, 2023, i called and cancelled an appointment on 06/16.2023 which supposed to be on 06/21/2023On 06.23/2023 i asked a refund.They are not telling the true because materials WAS not custom made and service WAS not provided.(According office "the services already provided, and the **************** that were prepared, these materials cannot be reused for another patient and our office would have to discard them").They never told me that materials are custom made,they didnt include price of materials in form which i signed(they include only full amount $8850 without explanation how much cost of procedure and materials).They never shown me an invoice of purchase materials which can prove that is custom made as well didnt return me these materials($2800 cost according office) if they charge me instead to discard them.

It is essential to emphasize that the Claimant was advised in two places where ******** had signed, both on the disclaimer and the credit card authorization form. This language was provided to ensure transparency and set clear expectations regarding the nature of the services. Given the customization of the order, the material produced was tailored exclusively to the Claimants specifications and cannot be repurposed or resold. Regrettably, this means that the material in question cannot be used by anyone else. While we regret that the Claimant could not proceed with the services, we must reaffirm that we are unable to process a refund of more than $6,050 of the $8.850 that was paid. We would be happy to still honor the refund of $6,050. We remain committed to providing excellent service to our customers and we appreciate the opportunity to address this concern through the Better Business Bureaus resolution process.Customer Answer

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:To Whom It May ********************* ************** *** *** *******The dental office provided a second response that is similar to the first. They didnt demonstrate any proof the biomaterials are custom made. In addition, Bensonhurst Dental care provided inaccurate information.
I had an evaluation and treatment at Bensonhurst Dental Care on 4/3/2023, 4/12/2023 and 6/12/2023, not two times like they have said.
I had paid $8850 on 6/12/2023 as an advance for future treatment of one tooth that was supposed to be performed on 6/21/2023. I called and canceled the appointment on 6/16/2023. According to the office policy,patients are to cancel an appointment at least 48 hours prior. I canceled 5 days prior. On 6/23/2023, I visited the office to ask for a full refund of $8850 but they didn't give me a refusal form.
On 7/5/2023 after I submitted a written request, I received an email asking me to sign a refusal treatment form and not on 06/23/2023 like they said.
According to it, they were ready to refund $6050 and keep $2800 for a service which was not performed and biomaterials that were never used. I have several questions to Bensonhurst Dental care:
1.Why didn't they mention CUSTOM made materials in the treatment plan?(see attachment #5).
2.Why didn't they mention the price of CUSTOM made materials in the treatment plan? They included only the full amount for service without explanation how much everything cost(see attachment #5).
3.Why on 6/23/2023 they were not ready to tell me the exact amount of the refund despite the fact on 06/12/2023 they had calculated everything in ** minutes and charged me $8850 to my credit card(see attachment #5 and and attachment #4($9275.00-$425.00(charged for service which was provided on 06/12/23)=$8850.00).
4.Where is the invoice of purchase CUSTOM made materials?
5.They know that I started a legal action against them. If they had proof, why did they discard the biomaterials and hide the evidence?(see attachment#** and response from Dental office to BBB on 08/14/2023)

Sept 22, 2022 I attended an appointment at Bensonhurst Dental owned by Marina Rubinshtein for dental services. The office asked for payment right away. After making the remainder payment of $5,000 , I was informed that the procedure will not be taking place therefore I will receive a full refund. I was provided a written documentation to ensure I will receive the refund of $5150 ($250 deposit and $5,000 for expected procedure) . Today is Dec 28th , 2022 and I have yet to receive back my funds. *** contacted the office consistently in regards to this matter however no calls or emails is returned.
