    Nature of Dispute: This dispute has started in the beginning of the year 2023. My loved one is deceased as of June 2021 and I as a family member who manages my deceased loved one mail was continuing to receive mailing from CDPHP. My deceased loves one received over 12 mailings. I contacted CDPHP and they keep telling me they are looking into it, and the last call I got is we will not get any more mailings.
    The company didn't resolve the issue and let me know why clearly my loved one was getting mailings. My loved one had an issue with identity theft, and I wanted to make sure it wasn't that.
    Can you help? I have all the mailings.

    I am writing in response to your inquiry dated 7/28/2023 (BBB Complaint ID: ********) regarding a complaint filed by ***** ****** for ****** ******.

    The Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) prohibits CDPHP from disclosing information pertaining to the complainant or subject of the complaint without a valid written authorization.  Please note, in accordance with HIPAA, the authorization may only be completed by the person under applicable law with authority to act on behalf of the decedent or the decedent’s estate, i.e., personal representative, and with the appropriate documentation of authority.  The HIPAA required CDPHP “Authorization to Release Health Information” form can be found at CDPHP.com, Members, Forms and Documents.  Upon receipt of the completed and signed form, CDPHP will respond with our position to the BBB.  Additionally, as warranted, CDPHP will directly reach out to the complainant to discuss their issue.  In the event the complainant is not the personal representative or has not demonstrated prior involvement in the decedent’s health care prior to the individual’s death, CDPHP will advise of the need for the personal representative’s authorization of CDPHP to discuss the issue directly with the complainant.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. 

    BBB spoke to the consumer and the following was relayed:

    I spoke with Fred at the business who was able to confirm that there is nothing related to fraud and that there would be no more mailings. I am satisfied with this outcome.
