On the night of 10/15/2023 Painless Waynes collected payment $40 for a service I no longer want and refuses to provide me a refund. The shop owner ***** was incredibly disrespectful over the phone when I asked and will not show me my contract I signed as of 10/16/2023 at 3:30 pm.

    Business Response

This complainant came into our shop and signed a contract for services that clearly states no refunds and shop credit only .....she signed up for services for the next day to get 2 very discounted tattoos for our Friday the 13th special...the next day before her appointment she called and stated " she wasn't feeling good" and that she wanted to come and get a refund then " rebook later" ...when I explained to her that we do not offer refunds and she signed a contract agreeing to this but that she can use her shop credit any time for the next year she became irate and began to tell me that I was going to do what she said or I would regret it...I don't take kindly to threats and told her to have a great day and hung up.

She then drove to my shop and began to berate my counter person and began demanding the legal disclaimer form she signed twice and initialed 12 times stating we were legally bound to release it to her ....when she was told to leave she refused and ultimately it took calling the police department and having her removed and trespassed....I have an event number ....now she's attempting to disparage my buisness ...I'm going to turn over her paperwork to the attorney we keep on retainer and he's going to issue a demand letter for a cash amount to reflect out time and trouble caused by this complainant as well as his fees for handling the matter other wise he will enforce the contract in civil court and also demand court costs fees and damages accrued by this ongoing issue.

After having the complainant removed from our place of buisness by the police...any and all credit that was owed to this person is null  and void as is explained in the 7 paragraph of the contract that was initialed by this complainant.

The contract has been pulled from our filings and was transported to our attorney on Oct 17th at 9:30 am.

    Signed

I am rejecting this response because:
I did not threaten the business nor was I removed from the premises. I stated that I would like to get my money back because it was not a deposit it was the Friday the 13th discount price I was quoted for the art I was looking for. I waited patiently in the shop the night I was looking to get it and was told that it would be an additional two hour wait on the time I had already been waiting and I was asked if I would like to book out. I fully intended on attending the appointment until I woke up feeling unwell. **************** answered the phone when I called what I assumed was the shop around 2:00 pm and told me Read what you sign next time and hung up on me. I then drove to the shop irate due to the complete lack of conflict resolution. I explained the situation to a young woman at the counter and she went and got a man from the back for me to talk to. We spoke for a few minutes and I expressed to the worker I have absolutely no problems with anyone in the institution but **************** due to the egregious nature of which he would communicate to a customer who has already paid where he then called **************** who threatened to have me trespassed. I then called 311 and spoke to someone who quite literally called the incident highway robbery and recommended I contact the BBB. I again would love to see where I initialed that my payment in full would not be returned to me for lack of service. I did not receive a tattoo from the institution nor would I recommend anyone to deal with Painless Waynes after this extremely unprofessional ordeal.
    Sincerely,
