    Arioso ************** provided me with a form stating that an appt is available for 12/1/2023. No units are available to view or rent for 12/1/2023. When I called the Assistant Mgr on 11/26/2023 I was told I would not get my money back because it is more than 72 hours. No units are available for 12/1/2023 to view or rent. This property mgmt company is running scams on Senior Citizens. I asked the property assistant mgr why did they even call me and she stated they are going by tenants notice to evacuate. however, notice to evacuate means nothing if the tenant changes there mind. After taking my $250..00 holding fee ****** from the office called me and told me I was approved but noting is available until 1/1/2024 - 1/15/2024. Why take my money if you have nothing available. I was on a waiting list. no need to contact me until something was available.

    I received the attached email from the girl that took my money order name ****** stating nothing is available and she will refund my money. I sent an email back stating that since she does not have anything available, I am no longer interested. but the mgr above her refuses to give me my money back.

    Hello,

    Thank you for contacting. I received an email from Arioso Apartments stating I can get my money back if I let them know by 12/12/23 that I am no longer interested and I replied back to the email but have not gotten my money back as of today.

    I think I will have to get a lawyer or take Arioso Apts to Small Claims Court. It's unfortunate this Apt complex wants to conduct business this way.

    ********************* was on our waitlist and was contacted by our leasing staff about an apartment that came available for the 1st week of January 2024.  ************ chose to except the apartment and chose to sign the attached reservation sheet and proceed with the approval process. The apartment that *********** choose to rent was held on 11/18/2023 and was not cancelled by her until 11/29/2023 which was over the 72 hour hold time, therefore per the signed reservation sheet the holding deposit was not refunded.

    I am rejecting this response because: The document I submitted to the BBB clearly shows an apartment was available for me to move in on 12/1/2023 from Arioso Apartments. Arioso Management lied to the BBB of ********* ** and Arioso Apts like to me as a consumer, knowing they did not have any apartments to show or rent. Also, it is very deceptive and dishonest business practice to call a consumer in 2 weeks before the fictitious move in date and collect money, then say they lose the holding fee if they don't cancel in 72 hours. What consumer would cancel if they are promised an apartment the following month, two weeks away (which is way more than 72 hours)? This complex sets consumer up to lose their holding fees and deposits knowing consumers will want to back out once they realize no apartments are available to view or rent. Consumers should not even be contacted until an apartment is available to view and rent. What an awful, awful scam, and on Seniors! with limited incomes! I want my $250.00 returned immediately!

    This is the email I replied back to Arioso Apartments when ****** emailed me telling me I had until 12/12/23 to cancel I would get my money back. ****** want to do the right thing but he Office manager above her wants to keep the scam going. I emailed back on 12/2/2023 stating thanks for emailing me and I do want to cancel because you don't have any apartments available to show or rent and the way you do business is bad. They need to stop playing games and stop lying.

    Arioso Senior Apartments is a 55+ affordable apartment community.  This property consistently remains 100% occupied and has a waiting list with potential applicants that want to lease and move in to the community.  Once a current resident provides notice that they are going to move out, the onsite staff begins calling the applicants on the waiting list.  We do not wait until the unit becomes vacant but works to prelease the unit.  In order to hold an apartment, we require the application fee and a holding fee that goes toward the deposit once the application is approved.  Upon confirmation and receipt of these funds, the staff stops contacting applicants from the waitlist as the unit is now preleased.  Due to the programs this property participates in, all income and assets have to be third party verified as they are income and rent restricted.  This all has to be completed in order for the applicant to be approved and ready to move in once the unit is vacated.  Arioso is leased sight unseen as you can see that we are preleasing units off of a waitlist as we very seldom have vacant units.

    We apologize for any inconvenience; however, the signed and acknowledged form previously provided shows the fee was not refundable if the applicant chose to cancel after 72 hours; which was actually cancelled almost 10 days later.

    I just want to say thank you for assistance in this matter. Although not resolved, it was helpful, and my next step will be to speak an attorney or take Arioso to small claims court. I am glad the BBB is there for consumers. Thank you.

    I am rejecting this response because: THIS COMPLAINT WAS CLOSED BY THE BBB. STAFF KEEPS COMING BACK WITH INSUFFICIENT INFORMATION TO SUBSTANTIATE THEIR MISCONDUCT. STAFF KEEPS COMING BACK AFTER 14 DAYS OR 30 PERIOD GRANTED TO REPLY TO A COMPLAINT.  THIS ISSUE MUST BE TAKING CARE IF IN A COURT OF LAW SINCE ARIOSO KEEPS UP THE NONESENSE SCAM AGAINST SENIORS
