On September 15, 2024 I purchased a massage chair from Evo Gadgets under the impression that I would be able to cancel the order if I changed my mind, as stated in their paperwork. The very next day, I discovered that Evo Gadgets had grossly inflated the retail price of the chair by over $4,000 compared to market value. Upon realizing this, I immediately texted the sales representative, ***, informing him that I would not proceed with the purchase and that I did not want the chair delivered.Despite my prompt communication and adherence to their stated cancellation policy (which notes a restocking fee would apply), Evo Gadgets has refused to reverse the transaction. The chair also included two "free gifts," which remain unopened and ready for return.Adding to this frustration, the sales representative pressured me into using their preferred credit card company, *******************, instead of my **************** card. I now realize this tactic was deliberate, as **************** would have canceled the charge without issue upon learning of this dispute. ******************** on the other hand, has refused to conduct a proper investigation into the matter, leaving me liable for a $6,000 charge for an item I have never *********** date, the chair has not been delivered, and I am being billed for an order that was canceled in good faith within the stated terms of Evo Gadgets cancellation policy. This businesss practices, from inflating prices to pressuring customers into using specific financing options, demonstrate unethical and deceptive behavior.I am seeking the following resolution:A full cancellation of this order and reversal of the $6,000 charge.Instructions for returning the unopened "free gifts" without additional cost to me.A formal review of this case by ******************* to ensure accountability for improper billing practices.I hope the BBB can help mediate this matter and hold Evo Gadgets accountable for their predatory practices.Business Response

Complaint: 22749863I am formally rejecting Evo Gadgets latest response, which falsely claims that Clause #6 in their contract allows them to charge the full $6,000 instead of a 30% restocking fee if I accepted "free gifts." This clause does not exist in my signed version of the contract. Evo Gadgets has failed to produce a copy of the contract I signed, further exposing their deceptive business practices.
Fraudulent Contract Claims
Evo Gadgets has referenced a clause that is not present in the contract I signed.
They have yet to provide a copy of my signed contract, proving they are fabricating terms after the fact.
I have a copy of my contract but am currently away for work in ******. When I return to my home in **, I will retrieve it to further confirm their dishonesty.Failure to Provide a Tracking Number or Proof of Delivery
Evo Gadgets still cannot produce a legitimate tracking number for the massage chair they claim was shipped. Instead, they provided a bogus response from a supposed shipping company with no verifiable details.
No delivery attempt was ever made, and no proof of shipment has been provided, which is crucial in validating their claim.
Unopened "Free Gifts" Ready for Return
I never accepted these so-called "free gifts" as a condition of purchase.
I explicitly asked for a return address to send them back, which Evo Gadgets never provided.
The items remain unopened and can be returned at any time, eliminating any justification for an additional charge.My Demand:
I reject this fraudulent response and continue to demand a full refund of $6,000 due to:
The non-existent Clause #6 they are now fabricating.

Hi *****,
First, I want to apologize again for any inconvenience or frustration you've experienced. I would, however, like to clarify a few details regarding the situation.On September 17th, tracking information was sent to you via text, and Ive attached proof of this communication. You responded to confirm receipt on your end. At the time you requested to cancel the order, the chair was already in transit. Our customer service representative informed you that, since the chair was already shipped, a 30% restocking fee would apply, along with charges for the gifts unless you chose to return them. Furthermore, given the language used in your messages regarding our products, we would have been happy to provide the return address to you.
Please note that we are not required to provide a return label for any items. In the dispute with Synchrony, we clearly stated that if you returned the gifts, we would amend the refund accordingly. However, as the gifts have not been returned, the original refund amount remains unchanged.
Additionally, *********************** is the company that handled the shipping and delivery of your chair. Our account manager, **** *****, is available for a call to discuss the details of your delivery, should you need further clarification.Regarding the 30% restocking fee: as outlined in your signed contract (which Ive attached for your reference), this fee applies if delivery is refused. Unfortunately, since the chair was refused per the communication from ***, we cannot waive this fee. For your convenience, Ive also included our shipment cancellation policy that is located on our website *****************, which states: "If your massage chair has already shipped, you will be responsible for both the round-trip shipping costs (to and from your address) and a 30% restocking fee. These charges will be deducted from your refund." Regarding the policy for gifts (attached for review) that is also included on out website states:" If you received free gifts (i.e handheld massager, LED Panels) as part of a promotional offer with your chair purchase, and the gifts are not returned in their original, unopened condition, the retail value of these gifts will be deducted from your refund. "
Please note all of our customers are fully capable of making their own decisions, and we do not pressure anyone into a sale or force a signature. If the chair isnt the right fit for you then its simply not a right fit.

I went in because I was in the market for a massage chair. The $12K massage chair was on sale for Black Friday, so I could get it today only for $6K. Then, because Im a local, I could get another $1K off. Because it was only $5K, I decided to toy with the idea. Now I know ******* buy their $12K chair on ******* for $200. While I was testing the chair, he was taking advantage of my poor mom. He brought her around the store attempting to push other cheap ******* products. He finally found out my sister suffers from migraines and the sleazy, slimy salesman used this to play on my moms emotions. He sold a $400 eye massager that they bought for $17.50 on *******. Oh, but dont worry, he was nice enough to give her a discount, so it only cost her $325. At this point, I joined the conversation. We were very, very hesitant and on the edge about it. ****** told us that if she doesnt like it or if she has one, we could return it. Heres my numberIll take care of you. Because he LIED and told us we could return it, we figured no harm, no foul, we would bite the bullet and buy it. After finding out she has an eye massager that does not work, we attempted to return it. *******, the manager, absolutely refused. He didnt care whatsoever that his salesman blatantly lied to us just to push a sale. My boyfriend and I purchased 2 iPhone cases and 3 pair of headphones from the kiosk located in The Forum Shops in ********* last week and we are very unhappy with the phone cases. They do not hold a charge for 4 days as the salesman told us and they will NOT charge while they are on the phones. I was in ********* and decided to shop at this mall. I was approached by a guy offering free cell phone glass protectors. Of course I was hesitant but followed him to his kiosk. He then proceeded to show me state of the art wireless headphones of course. After 30 minutes of selling and him bring the price down hundreds of dollars I agreed to purchase. Once I got home from my trip to ***** I realized what was in the box was an inferior product to what he sold me. They are scam artists and prey on tourists. The company is EVO Gadgets and ***** was the fast talking sales **** I expect scams on the streets in ***** but not in a reputable mall. They have a kiosk in the mall and a store as well. The mall should not have scammers as tenants
