March 2025 I was renting an apartment and **** the manager falsely accused my service dog of urinating on the carpet even though there was no smell on the carpet. I was forced to vacate. I received a video showing that there were no stains on the floor when the carpet was removed. I am a disable senior and had to rent a hotel room. Statement Regarding Miss **** **** ******** Tenancy
Miss **** **** ******** moved into our community on January 23, 2025, at 3:59 PM. Upon check-in, she informed us that she had a service ********* accordance with fair housing laws and our community policy, we did not charge a pet deposit or pet rent,as reflected in her receipt dated January 23, 2025. At that time, she paid a $75.00 security deposit, which was to be refunded upon satisfactory move-out conditions.
During a routine preventive maintenance inspection conducted on February 21, 2025, we discovered a strong ammonia-like odor emanating from Miss ******** apartment.The smell was so pervasive it could be detected from outside her unit. In an effort to resolve the issue, we issued a re-inspection notice for February 24, 2025. Unfortunately, during the re-inspection, the odor remained and had permeated the carpet to an irreversible degree.
Miss ******** was never asked to vacate due to her service animal. Instead, she was served a 30-day no-cause notice on February 25, 2025, solely due to the excessive odor and the resulting damage to the unit. When she disputed our findings, our Vice President, **** ******, and I, ***** ****, conducted an in-person inspection. Upon opening the apartment door, the odor was so strong I was forced to step away to regain my composure, and Mr. ****** was unable to enter the unit due to the intensity of the smell.
After continued non-compliance and no improvement, we served a 5-day notice for unlawful detainer on March 29, 2025, providing Miss ******** over a month to make alternative arrangements. She vacated the apartment on April 10, 2025, at 12:00 PM.
Post-move-out, we spent five days restoring the apartment to a habitable condition. The unit required:
Carpet replacement due to odor saturation: $468.60
Bed replacement: $294.99
Sofa replacement: $299.00
5 days of apartment not being rented $229.60
These damages totaled $1,292.19, significantly exceeding her $75.00 security deposit.

I am rejecting this response because: I called the office about a clogged toilet and BR sink leaking (my items were destroyed) I told **** the odor was coming from the clogged toilet. He said I was lying. **** also lambasted me for not having a plunger and not walking my service animal (elder abuse) I emailed the corporate office about the false odor accusation in addition to unclean appliances and furniture on 2/25/2025. ***** **** called me and made an appointment for 3/3/2025 at 10:00 am. ***** **** came to the unit and said he did NOT smell urine. Mr. ****** never made a comment about an odor. My service animal have traveled and stayed in many hotels. My service animal understand instructions better than some humans. Odor do not permeate carpet without saturation. Saturation leaves stains. There were no stains on the floor. I have asthma and living with ammonia odor would be deadly for me. ***** **** said he was not accusing my service animal. Is he accusing me? There was non-compliance and no improvement to make on an non existing problem.I was refused an additional 30 days. (protected class law) April 10, 2025 ***** **** inspected the unit and informed the office manager and myself that there were spots on the carpet near the door. I told him the spots were there when I moved in and that I took picture. He said he could not refund the deposit because of the spots. He told me to call corporate. I was never told about bed and sofa replacement. I would like to know the problem with the bed and sofa. The subject of excessive odor was never mention on April 10, 2025. The April 25, 2025 court date was removed from the docket. I was subjected to elder abuse, discrimation and extortion. ***** **** has accused a disable 80 plus senior and a 16 lb animal of massive destruction within a 60 days period!

My previous declaration was made to provide a factual account of the condition of Apartment R1189 following the departure of the tenant, Miss ********, and to explain the necessity of repairs and replacements made thereafter.
Despite Miss Williamsassertion that she was not aware of any odor during her occupancy, it is important to note that strong odorsparticularly those related to bodily fluids or animal wastecan become less perceptible to individuals accustomed to them over time. However, this does not negate their presence or impact. Property Managers and our Vice ******************** independently noted the offensive odor upon entering the premises during and after her departure.
As a result of the condition of the unit, the following actions were required:
Full replacement of the carpet in Apartment R1189 (see attached installation receipt and purchase order).
Disposal and replacement of bed and sofas that had absorbed the odor.
Deep cleaning and odor mitigation measures.
These actions were not taken arbitrarily or as a matter of routine turnover, but were necessary due to the uninhabitable condition caused by the persistent odor. The cost and documentation of these repairs are available and have been retained for our records.
Attached to this declaration are:
A copy of the carpet installation receipt.
A copy of the purchase order for the carpet specific to Apartment R1189.
Photographs showing visible staining within the unit.
A written statement from Mr. **** ******, Vice President who personally inspected the apartment and interacted with Miss ******** during her tenancy.
We affirm that these actions were taken strictly for the purpose of restoring the unit to a habitable condition for future tenants and were in no way related to any discriminatory or retaliatory motive.

**** ****** never entered the premises while I was present. Staining leaves spots on the floor. There were no spots on the floor. **** ****** never interacted with me. I never met him! ***** **** pointed to a stain near the door upon inspection the day I checked out. I told him I had taken a picture upon moving in. I never sent **** ****** an email. **** ****** never attemped to discuss a strong odor with me. ***** **** told me he did not smell urine. The man with him was never introduced to me nor did he identifed himself. The smell of urine on the sidewalk means **** ****** is accusing me of urinating in public. That is against the law! The unit is located in a heavy traffic area. I was living in a smoking triangle. The bathroom was smelling of smoke from the unit to the left. The tenant in the unit on the right smoked outside my door. The tenant on the upper level sat outside in a chair to smoke. I nearly got hit by ashes from the upper level because of flicking ashes. The smell of smoke was overwhelming whenever I open the door.All the units have the same furniture. Those pictures are not from the unit I had. One picture shows a cover mattress and a badly scratch dresser. The dresser in my unit was not scratch. Odor pentrated a cover mattress? I am corporate counsel for Budget Suites of America LLC, NV-704 and the company asked me to respond to the Complaint filed with the Better Business Bureau by **** ********. The positions of the parties are well known and unchanged. Budget Suites has previously responded twice to this Complaint and the allegations have not changed. Budget Suites of America claims that *********** *** had multiple bathroom accidents inside the apartment ruining the carpet, sofa and mattress, creating a terrible odor inside the apartment. Budget Suites of America LLC, **-704 has provided statements and physical evidence of the damage to the apartment. In addition to General Manager ***** **** and Vice President **** ******* statement, there are several more witnesses that can and will testify, if necessary, regarding the awful smell emanating from Ms. ******** apartment. Nothing that has been said directly to Ms. ******** or in response to this BBB Complaint have changed her mind. The photographs and invoices provided by Budget Suites of America LLC, **-704 have not changed Ms. ******** position either. Conversely,Ms. ******** denies the claim and wants Budget Suites of America, NV-704 to pay for her hotel stay and food after she left Budget Suites of America. That will not happen. Budget Suites of America understands Ms. ***************** and rejects them. Ms. ******** claims to have a video of when she checked into the property which purportedly shows the stains on the carpet at check-in. Even if Ms. ******** has a video showing some staining on the carpet, that does not explain the horrible smell. Budget Suites of America could not have rented the apartment smelling like *** urine and feces. This occurred during Ms. ******** stay and has been verified by multiple Budget Suites of America employees.
Budget Suites of America LLC, NV-704 has been content to this point not to pursue Ms. ******** for the damages to the apartment. However, if *********** continues to pursue this matter, Budget Suites of America LLC, NV-704 is ready to seek reimbursement of $1,062.59 for the carpet, sofa and mattress that had to be replaced before the apartment could be re-rented. Apartment F 2079 plays music very loudly. They sit in front of their apartment and get drunk with very loud music daily. Many residents have complained. The manager **** will not kick them out for consistent noise violations. Most people who live here are working class. Some people work graveyard and can't get sleep. The police can't do anything if management refuses to take care of the problem tenants. We pay $2,000 per month. This is unacceptable. It's been happening for several months now. Hello, I had a second stay at that prime location March ******* was not my best time though, my tv had not worked; cable company had to show almost a full weeks. Also the weeks of paying stay changed to three weeks at a time. Not a thirty day or weekly optional, as original stay on first visit came. I gave my present address **********************************. Never received deposit back from them this time. The manger and office staff never saw mail from Budget Suites or a deposit of any kind. I paid one month rent and was told by the desk clerk that the city of Addison required them to charge for telecommunication, and that this issue was being fought in court. Budget Suites of America responded, "The resident is mistaking the transient lodging tax that is being fought in court with the city of *******."The desk clerk stated that the city of *******, requires Budget Suites of America to charge Telecommunication, and that it's being fought in court with the city of Addison. All Utilities are paid. I have a smart phone with unlimited internet. I don't need a third party internet or Wi-Fi.I spoke with the manager about the telecommunication charge(s). The manager wouldn't explain what telecommunication charge was for, but stated that the corporate office wanted them to charge for telecommunication, and that I have to contact the corporate office about the telecommunication charge, Which is different than Transient lodging tax.TAX CODE CHAPTER 156: HOTEL OCCUPANCY TAX? Sec. *******. Tax Imposed.? Imposes a tax on a person who, under a lease, concession, permit, right of access, license, contract, or agreement, pays for the use or possession or for the right to the use or possession of a room or space in a hotel costing $15 or more each day? This is Budget Suites of America's third response to this tenant regarding the same issue. Budget Suites of America is legally allowed to charge a telecommunication fee. They have charged this fee for approximately a year. If the tenant does not want to pay this fee he is free to leave and rent at any other facility that does not charge this fee. There are no long term lease agreement signed by the tenant. Budget Suites of America allows tenants to pay weekly, bi-weekly or monthly. When that rental term expires tenants are free to leave or come to the office and pre-pay for another rental term (which includes the telecommunication fee). It does not appear this tenant will accept this answer and does not want to pay for the telecommunication fee. The tenant is therefore free to leave. Budget Suites of America considers this matter closed and will not respond to further complaints regarding this matter on this forum.

This is Budget Suites of America's fourth and final response to this tenant regarding the same issue. Budget Suites of America is legally allowed to charge a telecommunication fee. Budget Suites of America also gave Mr. ******* a ticket for the telecommunication fee. See Attached. Mr. ******* had the choice to rent with us and pay the telecommunication fee or go elsewhere. Dear ***** of the BBB:
If you review the fourth response submitted by *** ******, there is an attachment with the ticket (invoices) paid by the tenant at check-in. Ticket ******* has the letters TC at the top. This is the telecommunication fee charged. The tenant was told there was a telecommunication charge at check-in. The tenant agreed and paid the fee. On the same ticket you will also notice other fees charged by Budget Suites of America. MW stands for Microwave. HDTV stands for high definition television. Deluxe standard for a deluxe apartment that is rented for more than the standard apartment. The telecommunication fee is the only charge on ticket ******* and it has nothing to do with transient lodging tax paid by tenants for the first 30 days a tenant stays at the property. The property denies tenants claims indicating those fees are related. Budget Suites of America will not grant a refund for a fee legally charged and agreed upon by the tenant. Again, if the tenant does not want to pay a telecommunication fee, the tenant is free to leave as there is no lease agreement for this property.

On 11/10/2024 I paid my rent as usual. The next afternoon, I was called by the manager of the hotel. She told me that I was over charged. I went and checked my account, there was an almost double charge on my card. I was asked to send a screenshot of the overpayment. I sent a screenshot and I have not been reimbursed yet. I stayed at Budget from approximately May 18 2024 to July 1 2024. During my initial stay, I paid taxes for the first five or six weeks, and I was informed that I would be refunded for these taxes. I have not yet received it. I reached out via phone and email on 11/15/2024. I spoke with the manager who assured me he would overnight my check. As of 11/30/2024 I hadnt received my check so I followed up with the manager, ****. **** told me I had to come to the office and sign a form. That was done 12/5/2024. I was told the same thing, my check would be overnighted. As of today, 12/13/2024 I still dont have it. Hope you're doing well!Things got a little crazy for me in June I had a major surgery that ended up taking way longer to recover from than I expected. This threw a wrench into my budget, and unfortunately, I'm a bit behind on my weekly rent So sorry about that!I let the receptionist know about my situation and she stated that I have to be out before 12 noon and I had to let them know two days before I am moving out, but I had no attention of moving out. I was trying to come up with the rest of the rent money I had ***************************************************************************************** that they cant do it like that iso she sent the manager down to my apartment 1057 and he was telling me that , if Im not out by 12, they were gonna come in and put my stuff in the garbage bag and sit my stuff outside and I asked him dont he see me get it putting my stuff together to move out because I didnt have the rest of the money I told him too that I have *********************************************************************************************************************** well, I have to move out so i called him and asked him can I pay for one night he told me no he cannot do that but what he could do for me was to allowed me to stay another night and if I cant come up with the rest of the money, then I will have to move then he put on the record and Im no longer able to move back in there and I dont understand why because I was a good tenant. I never gave him no problem. I pay my rent on time , I've always been really good about paying rent on time, so this is definitely out of the ordinary. For the second time, it is impossible to respond without knowing the location the tenant resided. Budget Suites of America has NINETEEN locations in THREE states.

**** ***** has many of options where she can stay at other than Budget Suites of America. There are lots of options in the city of ************* and *********. Nobody is forcing her to sleep in her car. Unfortunately, she is on the 86 list which prohibits her from renting with any of our locations. We consider this case closed.

I didnt understand i didnt do anything for him to put me on the 86 list, i paid my rent on time never give him a problem, i had surgery in july i was short of money and i explained to him i ask could i paid 175 he no i was going to give him the rest of the money that following week he refused so i had no other choice but move out, he said i could stay until that thursday and if i could not come up with rest then i have to move,

I was recently living at budget suites location ******************************** My roommate contact me on Sunday November ******* to let me know that the rug in our bedroom was wet and also went to the office to to let the management know I was currently at work I call the office I spoke with someone about the issue at my unit and she let me know that the manager went and took a look at it she then call me back and told me the manager said they found the problem that the air conditioner was leaking on the inside instead of the outside and by the time I got off work they will have it fix.Once i arrive at my unit which was A-1006 the air conditioner was running and the sink was still fill with water I continue to the bedroom where I noticed my basket was on the bed fill with wet clothes that have been leak on and the carpet was still wet I took a shower and upon getting out the shower going to the bexri noticed something crawling on the floor which was a worm that I had also noticed before Sunday Saturday I noticed only one but didn't think anything of ***** upon Sunday once I showered and headed to the bedroom I noticed a worm crawling and looked like a big black bug I proceeding to kill both and started getting dressed and comfortable While sitting in the living room a started noticed a worm on the couch and more on the floor which I stayed up till 3am cause I couldn't sleep in a place like that.I went to the office the next t day and I ask the management could I be move to a different unit and explain to him about the worms,bugs,and water in sink and also showing him the picture he proceeding to tell me it was nothing he could do he would send someone over the next day to do the carpet again and I would have to wait until the water drys in the walls to get rid of the worms and bugs which is very unprofessional with me staying there and paying my money to them he didn't try to listen at anything I was saying and walk off.I'm sure I'm not the only one this has happened too.Business Response

I inspected the unit with the General Manager **** **** and found that the apartment did indeed have millipedes and pill bugs in the apartment because of the moisture in the apartment. I asked **** if she requested pest control which is available to any unit several times during the week. No pest control was requested and the apartment looked like it had been abandoned. I asked the ** to call the resident and see if they wanted to relocate to another apartment and the resident told **** that they already had moved to another apartment complex.

I have attached three documents that show ***** ******* was aware of the no rent refund while she stayed at the property. We provide free pest control services for the entire property several times a week for issues such as her. We also offered her a transfer to another apartment. Instead, she decided to move to another property. We will not offer a refund which she acknowledged several times during her stay and consider this matter closed.

I stayed at the extended. Stay budget suites for about four weeks. It was doing August to September 2024. I called on September 18 to see if my deposit would be refunded and was told yes it had been approved and I was to wait. Today is October 31 and I still have not received my $100 Refund for deposit. I dont know whats going on but this seems to be a problem with budget suites not returning peoples money. Taking 30+ days to process a refund is outrageous and todays time. I dont know if the checks are being stolen from the time that they issued. Theyre very vague about any information. And easiest things to say its been mailed and if you look at their reviews, this happens a lot 95% of the time.Business Response

I made a room payment of 1900 02 days a head from my monthly rent due and I I decided to check out 1 day later, the hotel refused to refund my money due to what they said their policy no rent refund, they operate like a hotel with tax charge plus rent , no lease like an apartment, I dont know if that was the right policy like a hotel because I didnt get the services.
