As per the uploaded Rental Agreement, Nevada statute NRS 118A.470 requires Falling Water to charge the holdover rent of $2,050 per month. Falling Water is charging $2,350 per month. I have requested Falling Water to refund the excess amount debited from my bank account. Regional Manager ************************* is refusing to refund the excess amount.

Per Mr. ******** lease his vehicle must be in working condition, and registered His vehicle was tagged on August 22 ********************************************************************************* the office that day very upset The day it was getting towed he had a cofronation withthe the tow company who ened up dropping the vehicle that day.

On 1/19/24 Mr. ******** car was tagged again by the the tow vendor- the tow company stated there was no parking pass in the window. The assistant manager called resident and told him if he came to the office and picked up a parking pass his car would not get towed. The parking pass was never picked up by the resident.

2/21/24 Mr. ******** car was towed off property, it had a flat tire and still being stored on property he called the office on  2/22 to state that I stole his vehicle I was shown pictures of the tire and the marks that were left showing that his car had not been moved since the last time the tow vendor was on site I gave him the telephone number to the tow company, I reminded him that he would have to have the vehicle fixed and registed so that it doesn't get towed again.

3/11/24 While out on property I saw ****************** with another tow company dropping his vehicle back onto the property.

Again per all leases - Only vehicles maintained in operational condition and licensed may be parked in approved areas.

I am rejecting this response because: The reason it wasn't operational at the time is because Falling Water fails to maintain a safe environment at their location. My vehicle has been vandalized so many times in the parking lot that catalytic converter was stolen which made the vehicle look like it was in-operational but the fact is it drives just fine.  I was working on getting this resolved but this company didn't give enough time.

I pay rent to have a place to park my vehicles and not be vandalized or towed. At the time this was my only vehicle.

Not only did Falling water not work with me to resolve this issue they purposefully towed my working vehicle (basically stole) at my so called "expense".  ********************* also removed me from my apartment due to water issues they had and never paid me back for my expenses.

    Sincerely,

    *****************************

****************** has had plenty of time to fix his vehicle, the issues with his vehicle getting tagged started a few years ago due to what he claims as someone stealing something off his car. This was back in June of 2022 .Unfortunitly, we can not prevent crime if it happens. During the pandamic we did not tag vehicles on property. Only after did we start to tag neglected vehicles on property. ****************** has neglected to repair his vehicle and it was stored on the property ever since. He never came to the office in June of 2022 to pick up a parking pass that was offered. His car was not towed at that time because the tag was placed by management so he could have a conversation with management on how long he would need to get his vehicle  fixed.

His vehicle still was not fixed in July, on the 20th we recieved a complaint from another resident about his specific vehicle just sitting there with parts hanging down from the engine.I called ****************** to get an up date about his car and also tell him about the complaint from other residents I asked him to come by again to pick up another parking pass he did not.

I did not hear about ****************** and his car again until after the first of year when his car was tagged by our tow vendor and there was an altercation between him and the tow truck driver. As I mentioned prioviously, his car was dropped from the tow truck at that time and again he was given another chance. Unfortunitly, his vehicle was tagged the following month by ********************* subsequently towed in Feb. It had a flat tire and was stored on property

Per the lease if a resident has a vehicle towed they have to get it our at the residents expense.

I am rejecting this response because: The business is lying there was no flat tire at the time of tow. This is a predatory tow scam falling waters is assisting/helping another business scam users out of their money.
    Sincerely,
