      Apartment itemized list of deductions provided after move out indicate false information causing charged to exceed the agreed upon cleaning fee and the deposited withheld. This apartment complex is fraudulent and including charges that are false. When discussing the charges with the property manager they offered a one time special of lower charges if I agreed to pay within 10 days. They need to be investigated as they would not provide proof of when the carpet was last replaced and would not provide move in documentation as requested.

      resident file, our apartment condition records and have found the itemized list
      to be accurate.We understand that *** *******a does not want to pay
      the costs associated with returning her son’s unit into the condition in which
      he received it, except for normal wear, however, as previously stated, we have
      found *** ********** itemized list to be accurate.

      I have written The Pavilions Apartments in Las Cruces ( 435 Ithaca Ct Las Cruces, NM 88011) to
      form**** dispute the deductions made from my security deposit. I have asked by fax, email and
      telephone that management has received my dispute and request for an itemized statement. They are charging me $2721.25 I am contesting the charge for carpet replacement listed in the move out statement provided to me. I believe this charge is unjustified as the wear and tear on the carpet falls within the realm of normal use.
      Addition****, I addressed an accusation of a pet being present in the apartment, which is entirely false. I am also disputing charges related to damages that were present prior to my son’s occupancy. I have photographic evidence that confirms these pre-existing conditions. I have respectfully requested a thorough review of these concerns and a revision of the security deposit deductions based on the accurate facts. The payment is due on September 4, 2024 and the apartment refused to take my calls, respond to emails inquires or faxed statements. Given the volume and consistency of the complaints, I believe there may be systemic issues with the management practice sat this property. Without any return contact with the Pavilions there is no way to discuss the charges, receive an itemized breakdown or discuss the false accusations withing their list of deductions. The accusations I wish to address are the false claims that I attempted to “cover up” stains or odors. I person**** cleaned the apartment. As a responsible parent, I would have been the first to address and pay any associated
      fees if I suspected there was a pet. However, there was never a pet ,and no urine odor was present. Any stains present were not intention**** concealed butt may have resulted from normal wear and tear.
      Due to lack of communication the Pavilions are not allowing for any conversation to discuss the charges they falsely claim is owed.

      To Whom It May Concern:

      Per our conversation with **** at the Better Business Bureau on
      9/23/2024, we did not receive the original complaint ID# ********.
      It appears there was some miscommunication, and the Better Business Bureau sent
      Ms. ******* the incorrect complaint ID response on 9/13/2024. We appreciate the
      Better Business Bureau for correcting this and giving us the opportunity to
      respond to this complaint.

      With regard to Complaint ID #********, we have reviewed Ms.
      *******’s complaint, Tenant file and the apartment condition records for her
      child’s apartment and have found her Itemized List of Deductions to be
      accurate.  To be clear, we have spent
      numerous hours researching and responding (7+ letters/emails) to Ms. *******’s
      various requests both verb**** and in writing.

      The *******’s and Murphy’s account is seriously past due in
      the amount of $1,621.25. These are actual costs to this company to restore the
      premises to the same condition in which they received it. Please remit payment
      in the amount of $ 1,621.25 to the Pavilions to immediately put this issue
      behind us.

      I am rejecting this response because:

      The Pavilions was paid in full by the required date(see receipt). The Pavilions chose to refund my son without explanation expect to say I have “alternate intentions” (see attached). They have also stated I misunderstood and do not know what is meant by that. The amount requested was paid in full by the date due by my son. This account is not seriously past due it was paid. I’ve been in contact asking why he was refunded with no response. This is the first time I have been told the account is past due when it was paid in full as evidenced by the receipt.
