    A Honorable Roofing Co. LLC and Vincent Koehl vs. NM Construction Industries Commission

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.


    On May 26, 2023 a hearing was held before the designated Hearing Officer for the Construction Industries Commission with the Assistant Attorney General and Administrative Prosecutor, appeared on behalf of the state. A Honorable Roofing Co, LLC and Vincent Koehl, appeared on their own behalf. All the parties appeared in person at the Regulation and Licensing Department located at 5500 San Antonio Dr. NE Ste. F, Albuquerque NM. The parties were permitted to present witnesses, cross-examination and present evidence.


    A Honorable Roofing, LLC was alleged in violation with the NM Construction Industries Division for failure to file for permits and inspections for work performed in previous years. Case #226-21-09 failure to Permit and Inspect timely. Failure to cooperate in an Investigation. Case #366-20-12 failure to permit and inspect timely, and knowingly Contracting and Performing service beyond scope of license. 


    After all evidence was presented in both cases A Honorable Roofing Co, LLC was to be in violation of 14.5.2.8(A) NMAC Failing to obtain a permit prior to starting work. 14.5.3.8(A) Failure to call an inspection in a timely manner. 14.5.8.8(A)(12) NMAC Failure to Cooperate in an Investigation. 14.5.2.8 NMAC for Failure to permit timely (Mechanical). Violation of 2015 IRC, Section R105-Permits, 2015 IRC Section R106-Not having approved plans and Manufacturers Installation Guide on site, and 2015 IRC Section R109.1.5 Decking Inspection and R905.10.5 Roof Underlayment. 


    On July 19, 2023 this matter came before the New Mexico Commission scheduled meeting. Respondents does hold a license and certificate under the Construction Industries Licensing Act. A Honorable Roofing Co is under the jurisdiction of the Commission. The Commission may revoke or suspend license. If work performed is $5,000 or less, the penalty shall not be less than $300 or more than $500. If the work performed is more than $5,000 the penalty shall be an amount equal to not more than 10% the contract but not less than $500. Failure to pay administrative penalty by date set by Commission there will be an additional penalty on $100 each day.  The Commission may assess penalties for unlicensed work. Vincent Koehl failed to timely obtain a permit prior to conducting work, failed to have roof work timely inspected, failed to ensure that the hired contractor pulled a mechanical permit for the venting and wiring work.


    Order:


    1. Respondent pay a $4,040 fine within 90 days from the date of order, with penalty of $100 per day if failed to pay after 90 days. 2. A Honorable Roofing Co, LLC's license shall be suspended for 90 days, beginning by date of order. 3. Vincent Koehl's qualifying certificate shall be suspended for 90 days, beginning by date or order. 4. Order shall run concurrently with Order in Case #226-21-09. 5. If Respondents fail to pay the fine in 90 days, license and qualifying certificate will be revoked.
