On 8/31/2020 we gave The Hilltop owner $15,000 in the form of personal check (which has been cashed by The Hilltop). It was tendered for a job to be performed at *** ****** ** ******** in Corrales, NM. The funds were to get our job on the schedule while we were still discussing the scope of work to be performed. We never arrived at an agreement and had no contract; no work was performed. For personal reasons we made a decision to cancel the project, and on 2/10/2021 we requested a refund Since then we have been in contact with owner Jim F******** who has promised payments and reneged on every agreement he has made to provide the refund. We and our family have done a considerable amount of business with this large landscaping contractor in the past and never expected them not to act in good faith. .We request resolution of this issue in the form of a full refund. Should the BBB requires more information please advise. Pls advise of any progress on this file.Business response

Hilltop installed an extraordinary front entry stuccoed block wall and side yard versa-lock wall in late 2019 and mid 2020. We then started working on phase 2 in the front. After numerous meetings and revisions we agreed upon a plan and proposal.
The pandemic hit and crippled our work force. We would average 40-50 men missing every day out of 180 employees. I had a stroke that took a major toll on my health and ability to run my business. I communicated this many times to the *******. In addition to my problems ******** called and announced they were getting a divorce and would be selling their house. She wanted their deposit back. I agreed to do so. Because of 5 hospital stays and trying desperately to run my business I did not respond to them as they thought I should. I apologize for that.
On July 9th ******** ****** and I agreed we would pay the $15,000.00 in three equal payments. She cashed the first check on 7-16-21 for $5000.00. The second one on 8-17-21 for $5000.00 and we will pay them the last and final check around 8-16-21 or 8-17-21. I believe this should close out a bad experience for all three of us. Thanks JF
