      I am writing to formally lodge a complaint against Powerflex Gym - Midtown for their inappropriate and predatory actions towards my stepdaughter, *** ******, who is a minor. It has come to my attention that Powerflex Gym - Midtown permitted Ava, who is currently under the age of 18 and not emancipated, to enter into a contract for a gym membership without the consent or presence of her parents or legal guardians. The contract is solely in ***** name, and given her age, she lacks the capacity to fully comprehend the obligations and consequences associated with such an agreement.
      Furthermore, Powerflex Gym - Midtown sold or hired ************** to collect the debt, & they have engaged in highly objectionable collection practices by contacting *** directly on her personal cell phone, without seeking permission from her parents or guardians. Despite being informed by *** of her minor status at the time the contract was signed and that she remains a minor, ************** disregarded this information. They proceeded to threaten her with severe credit damage if the alleged debt was not settled, employing intimidation tactics that resulted in significant distress for Ava, to the point of tears.
      Such conduct by **************, whom Powerflex Gym - Midtown contracted, including their intrusive phone calls during school hours, is not only predatory but also utterly unacceptable. It is imperative that these matters be addressed promptly to prevent further harm to *** and to ensure that such unethical practices are not perpetrated against other minors.
      I urge your agency to take immediate action against both ************** and Powerflex Gym - Midtown to rectify this situation and to hold them accountable for their actions. Thank you for your attention to this serious matter.

      We are very sorry to
      hear about this issue and appreciate the opportunity to explain the details and
      processes surrounding this particular membership. First of all, it is not our
      business practice to bully or intimidate any customer in any capacity no matter
      the circumstances, and this is something we would never do. We offer many
      different membership options, and always recommend that customers thoroughly
      read and comprehend the details of their chosen plan prior to signing. Our
      company utilizes very strict and consistent guidelines when processing and
      collecting membership agreement dues, including the requirement of parent/guardian
      signatures when a minor joins our gym. This particular membership was purchased
      on 9/15/22 from an offsite home computer, tablet, or phone. The membership was
      not purchased in person or in the presence of a qualified club staff or
      representative, so there was no option to verify the age of the member at the
      point of purchase. Furthermore, the member completed the required membership
      profile by providing an inaccurate date of birth. Based on this information,
      the age of the member at the signing of the agreement would have been 18 years
      and 4 months (a valid age entered to bypass the online agreement requirements
      for minors). During the online signup, the member also agreed to all membership
      terms and conditions and completed the purchase. Our records indicate the
      member visited the gym only one time during the course of this particular
      membership term, which would have made it extremely difficult to verify age
      eligibility for the membership purchased. During the natural course of
      membership agreement collection, the balances for all past due memberships are
      automatically sent to our partner collection agency. Once this action occurs,
      Powerflex Gym-Midtown no longer owns the account and the membership becomes
      inactive. At the time of transfer, Net Collections was unaware (due to the
      incorrect birthdate information) that the member was a minor. Had they known
      this fact prior to initiating collections efforts, they would have ceased
      attempts moving forward and removed the agreement from their system. After
      beginning the collection process, Net Collections informed us that the member
      was actually a minor and could not continue pursuing the debt. As of this
      current point in time, Ava’s account has been officially closed by both
      Powerflex Gym-Midtown as well as Net Collections. Net Collections has confirmed
      this action via response to their own complaint. We are very sorry for any
      stress this may have caused Ava, but we assure you that we acted in a
      completely professional and transparent manner given the information provided
      and the circumstances of the situation.
