I am filing this complaint on behalf of my company ***************************** LLC dba Joint ****************************** On April 27, 2021 I purchases a trailer from Performance, Trailers, 1) I was due a refund since I paid for the taxes in cash and **** use my credit card and added this fee in with that card, resulting in a overcharge that should have been refunded that never happened. 2) To add insult to injury the registration for the trailer expired on May 27, 2021. I spoke to ****** twice concerning the refund and to notify Performance of the registration expiration date. She claimed they were sending it out which again did not happen until I received the title via *** on July 7, 2021 way beyond the expiration date In the meantime, I received three tickets for the expired sticker, trailer was towed, impounded which I had to pay for the tickets, towing and impound fee before the trailer could be released to me from Jardiim Auto Body Provide the *********** with insurance and title. Then had to provide a new registration to the ******** ** police ***** I sent a letter and invoice to Performance for a total charges of towing, impounding fee, towing the trailer back to my yard and loss time hours since my work had to be canceled the day the trailer was towed. Then I finally received a letter from Performance management with an apology, with NO refund of this entire invoice dated 12/20/21 I would like to have BBB to contact them so I can receive payment for this total inconvenience sooner than later. They need to know they can not continue to disrupt company's businesses and get away with type of tactics.***************************** LLC -

Brief Summary of reply sent via **** : *USTOMER ****** D, knew she did not have trailer registered, and used it anyway. ONE of the Summonses was for ILLEGAL PARKING. which would have been illegal and caused the Trailer to be Towed even if it had been registered. The copy of the Parking Ticket sent by *ustomer was tampered with / altered, apparently to deceive the true reason for the trailer being towed, and ticketed. Further the paperwork WAS sent *** and signed for by ************************* 7 days BEFORE the trailer was ticketed and towed. 4/27/21. ****** D purchases trailer in name of JMS LL* 4/28/21. ****** D arrives to pick up trailer. 30-day temp tag issued Tow vehicle is not equipped to tow trailer; *ustomer leaves without paperwork to get another vehicle to tow trailer 4/28/21. *ustomer returns, picks up trailer, does not return inside office to obtain paperwork *ustomer does not return calls from Liz * 7/6/21. *ustomer finally contacted by Ms. *, at which time she provided address for shipping documents via *** overnight (Performance did not charge *ustomer for ***; complimentary service). *ustomer has actual knowledge that trailer is not legally registered, and used it anyway. Paperwork in signed for by ****** D on 7-7-2021 , 9 days BEFORE summonses and towing. 7/16/21. *ustomer or agent parks trailer illegally, receives summonses for both unregistered vehicle and illegal parking 7/22/21. *ustomer sends letter to ********************, enclosing copies of two summonses, two towing invoices, one for impound tow, second to tow trailer out of impound yard 12/8/21. Performance receives another letter from *ustomer dated 10/23/*************************, Inc. denies any fault or responsibility for your unfortunate experiences. Performance is not responsible for the summonses, fines, towing fees, impound and transportation fees, or any other incidental or consequential expenses or losses suffered by you as a result of your ill-considered actions. Unfortunately, the inaction by you and/or your agent in not taking steps to legally register the trailer upon possession resulted in the problems you experienced. We sincerely appreciate your past business and your purchase of a trailer from our company.
