Government Action: BBB reports on known government actions involving business’ marketplace conduct:
    Consent Order

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

Newark, May 20, 2022 - Acting Attorney Matthew J. Platkin and the Division of Consumer Affairs announced that they had settled their investigation into Lynnes dealerships  alleged consumer protection violations.  Lynnes agreed to a $46,381 settlement—which includes $33,500 in civil penalties to resolve allegations that included charging consumers for certain fees twice, accepting incomplete credit applications from prospective buyers, and failing to list vehicle prices on sales documents.

Lynnes voluntarily cooperated with the Investigation and agreed to the entry of the Consent Order without admitting it violated the CFA, the Motor Vehicle Advertising Regulations and/or the Automotive Sales Practices Regulations.

Lynnes also agreed to enter binding arbitration through the Division’s ADR Unit to resolve all pending complaints from affected consumers and to arbitrate, if necessary, any additional consumer complaints received by the Division for a period of three years.

A portion of the settlement amount will be suspended and automatically vacated provided the company complies with the terms of the agreement.
