Signed a contract with Robert on 6/25/21 for construction on our patio. We paid him a $3,750 cash deposit. When work finally began in September, it became apparent that he did not order all the materials. He installed stairs that were smaller than what we agreed on in the contract. He did not order the wall block we agreed upon in the contract either. When we showed him the contract again, he stopped work to locate the wall block and send a team to pick it up in Connecticut. We were told on Friday that the team was in a car accident and couldn't be by that day as promised. Weeks went by. When he sent someone to pick up some of their equipment, that person didn't know about the accident and said the team had Covid. We asked repeatedly if he would finish the job and were always told it would be next week. We asked for our money back or an itemized invoice for the work completed, but have received no response. He left us with a gravel pit instead of a patio.Initial Complaint

On August 6, 2021, I signed a mutually-executed contract (attached here) for the Contractor to install a walkway and patio. I paid a $4650 deposit to the Contractor as required by the contract. (see attached.) On August 26, 2021, through a certified letter sent to the Contractor (attached here) at his place of business, I canceled the contract for the stated reasons. I asked for the return of my deposit consistent with the terms of the contract. Since that time, the Contractor has refused to return my deposit. He texted, claiming that he mailed a check. My request that he provide scans of the deposited check have been ignored. (see attached files) I emailed the Contractor (see attached) asking him to open communications and use a payment play to return my deposit, if needed. The Contractor now refuses to communicate.
