    Cheney poured my concrete floor last November when night time temperatures were below freezing. They failed to cover the project to prevent freezing. The floor is scaling due to freezing after they finished it. Ive been trying to get the owner ***** to address the issue. I have sent a number of emails and even stopped at his place of business and had a discussion about this. He refuses to address the problem. I have had a number of contractors confirm the is just poor workmen ship. I want the portion of the damaged floor. Approximately 20x20 covered with an epoxy.

    We understand that **** ********* is dissatisfied with the outcome of his concrete garage floor, he is complaining about what he believes is ************ at KM Cheney Concrete, **** (KMCC) we believe it is a matter of improperly cured and cared for concrete.

    -The freeze-thaw cycle is a major cause of damage to concrete.
    -Freeze-thaw damage occurs when water fills the voids of a rigid, porous material and then freezes and expands.  The volume of frozen water is 9% greater than liquid water, so when water freezes pressure is exerted on the surrounding material, and when the pressure exceeds the tensile strength of the material, cracks will result. During this process, the voids are enlarged, enabling the accumulation of additional water during the next thaw; this results in additional cracking during the next freeze.  Substantial damage can occur over subsequent freeze-thaw cycles.
    -I have attached the calendar for November 2023 showing the weather and temperatures in ******* NH for the 28-day period after his concrete garage floor was poured, showing a prime example of daily freeze-thaw cycles.

    Per our executed contract with Mr. ********* the Terms of Service under Limited Liability section 3 states:
    -**** shall not be responsible for damage or other quality issues to concrete caused by weather or other uncontrolled environmental or mechanical sources, or by another contractor/sub-contractor or third party. Winter conditions (freezing/thawing) and the use of salt (or other de-icing agents) may damage concrete. **** shall not be responsible for damage due to exposure to these environmental elements and de-icing agents.
    -I have attached our contract with this section highlighted for review.
    -The pictures and videos that Mr. ********* previously shared with us show that he left it exposed to snow and ice all Winter. Additional pictures he shared show water still getting on the floor in the Spring.  

    Mr. ********** disputed amount of $40,000.00 for his garage floor is incorrect. The project total for his concrete foundation (footings and walls) and concrete floor was $40,685.00. The invoice total for the concrete garage floor was $19,890.00, and per Mr. ********* only a portion of the garage floor is showing signs of damage.

    If Mr. ********* can provide evidence that he used heating measures to prevent the concrete floor from freezing and that the concrete floor surface was kept dry during freezing temperatures, we will replace his garage floor at no charge.
