On September 5, 2024, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business violated provisions of the Fair Debt Collection Practices Act (FDCPA), in violation of Minn. Stat. 5 332.37(a)(12) (2021). Alleged FDCPA violations include failure to validate consumer's debt; failure to cease collection after consumer disputed debt; overshadowing deadline for consumer to dispute debt; and reporting consumer's disputed debt to credit bureaus without providing validation.
Under terms of the Consent Order, the business agreed to pay $2,000.00 of a $10,000.00 penalty, with the balance stayed on the condition that the business has no future violations of any law, rule or order under Minnesota Department of Commerce authority; to cease and desist from violating any laws, rules or orders related to the Minnesota Department of Commerce authority and to pay $180.00 in investigation costs.
