    Date of transaction: Aug 20, 2025 Amount owed: $*************: Apex Waves LLC (contact: ***** *******).I sold Apex Waves LLC - 3x NI Hardware PCI Cards(PO#****). We agreed that payment would be made by company check mailed to my U.S. address in ***** (I reside outside the country). Despite assurances that the check had been sent, no payment arrived after four weeks.When I followed up, Mr. ******* acknowledged the delay and offered to cancel the check and pay by wire transfer. Over multiple emails he indicated he would proceed with the wire, but no transfer was made and I have not received proof that the original check was ever mailed or canceled. As of today, I have neither received the check nor any wire payment, and my recent emails have gone unanswered.Nature of dispute: Non-payment for goods delivered.What the business committed to provide: Timely payment by mailed check (later, payment by wire after canceling the check).Resolution efforts: I sent multiple follow-ups requesting either (1) confirmation and tracking for a re-issued check, or (2) a same-day wire. I also provided my wire instructions. No payment has been made.Requested resolution: Immediate payment of the full amount due by wire transfer, or overnight re-issued check with tracking; Written confirmation of payment and (if applicable) stop-payment/cancellation of any prior check; A point of contact for any remaining questions.Supporting documents available upon request: invoice, proof of delivery/transaction, and email correspondence showing the payment promises and follow-ups. My Personal conclusion is that Mr. ******* has been ignoring me due to my show of frustration and anger during our first email exchanges but emails will show that I have been willing to work with him, yet he has proven difficult to work ******* requesting BBB assistance in mediating this matter so I can be paid for the hardware Apex Waves purchased.

    We appreciate the opportunity to clarify this situation and confirm that Apex Waves LLC has at all times acted in good faith.

    A check for $1,500 USD was issued and mailed to the sellers designated U.S. address in ***** per the original agreement. The seller later confirmed that they were located outside of the country and did not have direct access to that address to verify or receive the check. After learning this, we offered alternative payment methods to expedite resolution, including wire transfer and ******, but the seller declined or changed preferences during the exchange.

    At no point was payment intentionally withheld. We have continued to make every reasonable effort to ensure that the seller receives full payment and remain willing to issue a replacement payment via their preferred method (wire or ******) once we confirm that the original check is voided or uncashed, to avoid duplicate payment.

    This person has admitted multiple times to becoming emotionally unstable, despite my best effort to ensure a check was mailed. However, they did not believe me - even though they were not physically capable to confirm this because of the location difference. 

    We regret the frustration this situation has caused and will gladly provide the BBB with copies of email correspondence showing our repeated communication attempts and willingness to resolve this matter.

    Our intent is, and always has been, to honor our financial commitments promptly and professionally. We will continue to cooperate fully to bring this matter to a close.

    Resolution Offered:

    Immediate payment via wire or ****** (sellers choice) upon confirmation of the uncashed check.

    Written confirmation of payment completion once finalized.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. I do not agree with his interpretation of the events, I offered him multiple chances to respond and act if good faith which he refused. Payment has been confirmed and we can close out this ticket.
