On April 20th, 2021 I was celebrating my daughter 31st birthday at The Famous Toastery. I was accompanied by my son in law. We had just sat down, ordered our drinks and I wanted to take some pictures of my family. I got my phone out and leaned about 30 degrees towards the table. Then all of a sudden the chair shot out from up under me. Immediately my family and my waitress raced to check on me and to help me up.  The supervisor came to my table right afterwards. Supervisor said she will fill out an incident report for insurance purposes in case I needed medical attention later. I didn't feel the pain really bad until I got up and walked to my car. I left and went straight to my Doctor.  I asked supervisor for a copy of the incident report and who I needed to contact after I got medical attention. She gave me the contact information for the owner. I went to my doctor the same day around noon. Nothing was fractured or broken but sprung my right **** cheek she did write me out of work. When I got all my information together I reached out to the insurance company to file a claim to be reimbursed for my pain and suffering and missed days out of work. The claim adjuster she has not replied to me. Then I talked  to a  Attorney and he explained to me that 10% of the incident was my fault and 90 % of the incident was the company's fault. Most establishments who have wooden chairs that have the tendency of sliding they put some type of rubber on the bottom of the chairs and also the tables so these types of incidents do not happen. This establishment did not in absolution make sure that an incident like this would happen. They should be held accountable for not doing so and pay for my pain and suffering and missed time at work.
