    I told this daycare that I was going to unenroll my children from their care on 09/10/2024 and that their last day would be 09/24/2024. The business said in the contract that I just needed to give a two-weeks notice. It did not say that I would be charged by the week for the entire week that I unenrolled my children. I asked for my money back for the three days that week that my children were not enrolled and they told me it was in the contract. It was not in the contract. The contract just says a written two weeks notice which is what I provided.

    Kiddie Academy has adhered to the policies and procedures outlined in our enrollment agreement, which was signed by Mr. and Ms. Vogel prior to their children’s enrollment.

    On September 10th, Mr. and Ms. Vogel sent an email providing notice of their intent to withdraw their children from Kiddie Academy. In that email, they stated that their children’s last day of attendance would be September 24th. According to our academy's policy, as stated in the signed enrollment agreement:
    Withdrawal Notice (Policy #4): “You must provide WRITTEN NOTICE at least 2 weeks prior to your child’s last day of attendance. Failure to provide the required NOTICE will result in additional tuition obligations for the notice period.” 

    As per the agreement, tuition for the two weeks following the withdrawal notice remains the family’s responsibility.

    Furthermore, the agreement also clearly outlines:
    Tuition Payments (Policy #7): “Current WEEKLY TUITION for your child is $400.00 and is due IN ADVANCE on Monday.”
    Non-Prorated Tuition: The weekly tuition is not prorated for any reason, therefore no matter what day of the week a family puts in their notice of withdrawal, they have two weeks remaining of tuition to be paid.

    Given that the Vogels submitted their notice on Tuesday, September 10th, they were responsible for the remaining two weeks of tuition, including the weeks of September 16th and September 23rd. Additionally, as they indicated that their children's last day would be September 24th, the family was obligated to pay for the full weekly tuition for the care their children received.

    Kiddie Academy is committed to operating in compliance with our established policies and ensuring transparency with our families. We respectfully assert that we have followed all terms outlined in the enrollment agreement signed by Mr. and Ms. Vogel.

    Upon reviewing the contract, I have noted several discrepancies:


    Contractual Payment Obligations: The contract states that I am responsible for paying tuition up until my children’s final day of enrollment, which was September 24, 2024, per my two weeks' notice. However, the contract does not specify that I would be required to pay for the entire week following their unenrollment. Since my children were not enrolled beyond September 24, I should not be responsible for the full week’s tuition. It does not state in a contract that I signed that I would be responsible paying for the entire week. 


    Breach of Contract: On August 26, 2024, Kiddie Academy failed to open on time, which is a violation of the contract. This breach directly impacted the services I paid for, and I believe it should be taken into account when considering any outstanding balance.


    Partial Tuition Discount: As per the contract, if my children do not attend for the entire week, I am entitled to a 50% reduction in tuition for that week. This provision should apply, and the appropriate discount should be reflected in the final charges.


    Based on these points, I kindly ask that you review the charges and provide a revised invoice that accurately reflects my financial obligations in line with the contract. I look forward to resolving this matter quickly.

    An extensive response has been written and is attached to this response in the form of a PDF. It is labeled as "Response from Kiddie Academy According to the Policies". The Enrollment Agreement for both Vogel children that is sited was attached to our first response. We have also attached communication emails siting the refund that has already been offer to the Vogel family. We maintain that we have properly adhered to all Kiddie Academy Policies, Procedures, and States Guidelines.

    I am rejecting this response because:
    They did not respond to the 50% off tuition for students that do not attend for an entire week which is stated in the contract. They also did not address the inconsistency that exists in the contract of not specifically mentioning that I need to pay for an entire week after my children were not enrolled. I gave a two weeks written notice. The contract does not say anywhere about paying for the week despite not being enrolled. This was even confirmed by a representative of Kiddie Academy headquarters.
