    LyRubec Properties DBA Rubec Properties has been retaliating against me and harassing me because I filed complaints with the *************************** your office, Fair Housing and the ************************** This is the most recent incident. I have uploaded my complaint that I am going to notarize and send to Rubec Properties. Rubec Properties is guilty of breaking the following penal code: ****** Harassment of a rent regulated tenant in the first degree.An owner is guilty of harassment of a rent regulated tenant in the first degree when:1. With intent to induce a rent regulated tenant to vacate a housing accommodation, such owner:2. With intent to induce two or more rent regulated tenants occupying different housing accommodations to vacate such housing accommodations,such owner intentionally engages in a systematic ongoing course of conduct that:(a) impairs the habitability of such housing accommodations; or (c) is reasonably likely to interfere with or disturb, and does interfere with or disturb, the comfort, repose, peace or quiet of one or more of such rent regulated tenants in their use and occupancy of such housing accommodations including, but not limited to, the interruption or discontinuance of essential services; or 3. Such owner commits the crime of harassment of a rent regulated tenant in the second degree as defined in section ****** of this article and has previously been convicted within the preceding five years of such crime or the crime of harassment of a rent regulated tenant in the first degree.The good faith commencement and pursuit of a lawful eviction action by an owner against a rent regulated tenant in a court of competent jurisdiction shall not, by itself, constitute a "systematic ongoing course of conduct" in violation of paragraph (c) of subdivision two of this section.Harassment of a rent regulated tenant in the first degree is a class E felony.

    We have reviewed Ms. ****** complaint and find it difficult to comprehend her grievance. We have not engaged in any form of harassment, or retaliation against her. Based upon our interaction with her, she seems to believe she is a target with no legal or factual basis. It also appears that if she does not agree with an action taken, she perceives it as an offense and starts a letter writing campaign against us without cause.
    Regarding the water heater, we received a work request on April 5th, advising us that the hot water heater was leaking. Our maintenance technician visited the property, and repaired it based upon his assessment. He also found that the tenant had turned off the hot water and he relit the water tank.  

    On April 16th, the tenant contacted us to let us know she had been without hot water since April 2nd.We sent ************** to the property again to re-assess it and he recommended that a plumber evaluate the water heater. The plumber evaluated the water heater on April 17th and repaired it.
    We would like to clarify that Ms. ****** claim of being subjected to name-calling and being called a liar is entirely false.We have actively sought to address her concerns by requesting a direct conversation to gain understanding and resolve the issue. We believe that open communication, rather than written correspondence, would facilitate a better outcome in this matter."

    I am rejecting this response because:

     

    I am sending you documents to add to my complaint. Please review attachments.

    I want acknowledgement that the lease in question is void and unenforceable. Also, I went over half of a month without hot water and some days without water at all; from 04/02/2024 -04/17/2024; I believe in retaliation of my complaints against Rubec Properties. I want to be relief and release as the law dictates regarding these experiences and for Rubec Properties to respond to the ** statues it's in violation of in the lease in question.

    We have addressed the matters put forth by the tenant in this complaint previously and will not continue to respond to the same. She has written letters to other agencies regarding these same complaints, such as the ** Attorney General and we feel we have adequately responded to her allegations.
