On The Way Towing illegally towed from private property. My vehicle was parked on my mother's property. Someone bought land on the other side of my mother's property wanted to use her land to get to the property they purchased. The easement for their property is though Hwy 53 not my mother's land. The county records show proof of this information. The Tow driver went on to the property after seeing the no trespassing sign hanging on the rope. He pulled the poles out the ground the rope/no trespass sign was hanging on. My mother continuously told (Tow driver) *****, it was private property, and for him to leave. I told him that it was my truck and I did not call for service, nor did my mother. He said he was called to remove the truck so the people that bought a mobile home could get to their property. He hooked up to the truck, and would not release it. He held the vehicle hostage. I was forced to pay $350 because the people that called him refused to pay. The tow driver threatened to take my truck to a pound, and charge $1000 plus $100 dollars a day. Based on that conclusion, I paid $350 to release the truck. The property is not an Easement, it is not Landlocked, and it is not an Emanate Domain...This is a Non-consensual tow, which means the transportation of a vehicle without the consent or knowledge of the vehicle's owner, possessor, agent, insurer, lien holder, or any other person in possession of or in charge of any vehicle and includes the transportation or towing of the vehicle under lawful circumstances. Tow companies must obtain written authorization from the property owner or lessee before towing a vehicle from private property or parking lot. Non-consensual towing businesses must obtain a permit from the Division and renew it annually. Occupied vehicles cannot be towed or attached to a towing vehicle. N.C. Gen. ***** 20 ***** No DOT# was stenciled on the truck while hauling an 18 *******, Freightliner over ****** lbs, this is a violation of *****.
