Reported *** to the ** Division of Health Service Regulation Complaint Intake and Health Care Personnel Investigations Section for unsafe practices in violation of NCGS Chapter 122C: (1a) " a violation by a facility of the regulationsof this Chapter or applicable State or federal laws and regulations governing the licensure or certification of a facility which results in SUBSTANTIAL RISK THAT DEATH OR SERIOUS PHYSICAL HARM... *** places potentially dangerous patients displaying acute withdrawal symptoms into rooms with other patients rather than directing those with dangerous withdrawal to hospital emergency rooms.Moreover, the facility has no food preparation, cooking, or cleaning facilities. Residents meals are catered off-site and brought in single-serving containers served in violation of 15A **** Admin. Code 18A.3626 (h) and (i), which state: (1) the food is marked or otherwise identified to indicate the time that is four hours past the point in time when the food is removed from temperature control; (2) the food is cooked and served, served if ready-to-eat, or discarded, within four hours from the point in time when the food is removed from required temperature control; (3) food in unmarked containers or packages or marked to exceed the four hour limit in Subparagraph (1) of this Paragraph, is discardedIn practice, the caterer for the *** delivers potentially hazardous foods, as defined by Food Code Adoption in ************** at or near room temperature with no markings indicating time at which they were removed from required temperature control as stipulated by Sec. (i) above. The unmarked potentially hazardous foods are left on a serving table with no temperature control, and are left at room temperature for indeterminate periods of time often exceeding 4-6 hours, then placed in a refrigerator for ad hoc consumption by facility residents unaware the food has been exposed to unsanitary conditions conducive to bacterial growth.
