    On May 16, a payment was mailed (post marked 5/16) to Payment servicing Corp for payment for the account of ******** ******. The check was post dated for 5/28/2025 for payment due on 5/21/2025. A 7 day grace ****** is within the time for the payment being on time.The post dated check was presented to *************** on 5/23/2025. *************** promptly returned the check since it was non-negotiable until 5/28/2025. It was not returned due to ***, it was returned because it was post dated.Payment Servicing Corporation did not process the check correctly thus, their bank charged them *** and reversal fees. This company is charging us these fees for their incorrect processing of a post dated check and in addition charging us a late fee when the payment was not late. American Servicing Corporation processed our payment incorrectly. Processing the payments correctly and diligently for their clients is their responsibility. Any bank charges that resulted from their error is their responsibility to pay. A fair resolution would be for American Servicing Corporation to not charge us for their bank fees and remove the late charge totaling $147.50 The total owed is $332.50; $185.00 for the **** $60.00 for the *** and *** Fee; $60.00 for the Reversal/Modification Fee and the *** Fee; $17.50 for the late fee. They should not charge us $147.50 in bank charges and late fees.

    Payment Servicing's response to this complaint is attached and is the same response as sent to the DFI.

     

    A fair resolution at this point is for Payment Servicing to receive not only the *** Fees and Reversal/Modification Fees but also compensation to deal with and respond to the complaints made by the complainers.  We are due $200.00 for time it has taken compiling and copying the documents to respond.  This is a frivolous complaint and matter.
