  • On October 13, 2022, James McDonald d/b/a Asphalt Paving & Professional Coating entered into a Settlement Agreement with the U.S. Department of Transportation, Federal Motor Carrier Safety Administration. The Settlement Agreement resolved an Amended Notice of Claim alleging the business violated federal motor carrier safety regulations by allowing, requiring, permitting, or authorizing a driver to operate a commercial motor vehicle during a period when the driver did not have a current commercial learner’s permit or commercial driver’s license, or did not have the proper class or endorsements.

    Under the terms of the Settlement Agreement, the business agreed to pay $100 of a $4,470 civil penalty, with $4,370 held in abeyance. The business also agreed to cease all motor carrier operations in interstate commerce and agreed that its USDOT number would be inactivated. The business and its owners, members, officers, or directors agreed not to reapply for a USDOT number or operating authority registration, and not to directly or indirectly have a financial, ownership, management, or safety role in any for-hire or private interstate motor carrier subject to U.S. Department of Transportation jurisdiction, for five years from the date the agreement was executed by FMCSA. The agreement states that execution of the agreement constitutes admission of the violation set forth in the agreement.
