    On May 7, 2023 I ordered prints from Emblematiccreative LLC (Etsy) and received them on May 18, 2023. The 2 prints did not comport to the photo in the ad of the company (they were grainy and colors washed out). I immediately sent them back at my expense in pristine condition and in the same packaging via USPS which the seller received on May 25, 2023. After not receiving a refund I contacted the seller and asked when I would receive said refund. The seller indicated they would not refund to any customer who has left a bad review of their product. I advised I would then submit a complaint to the BBB and Etsy. The amount of purchase was $40.92. The seller stated they didn't care about my $$$ and they stated on their site there were no refunds; however that was not on their webpage. They did say exchanges were available. I am out the $40.92 and the prints and the seller has been making unprofessional and smug comments. I want to be made whole. I have copies of all of the exchanged between me and the seller.

    It is my store’s stated policy that purchases are final sale; I do not accept returns.

    Please note that this item is a final sale. I do not accept returns or offer refunds. Please read the listing description before purchasing. If you're unable to understand the product or nature of the sale, please contact me prior to purchase.“

    "*****, my store policy — posted clearly on my shop page and repeated on every listing, is that all sales are final; I do not accept returns. You elected to send your prints back to me, without having an authorized return."

    This case was adjudicated by Etsy: they ruled against the complainant, in my favor, stipulating that since it is my stated store policy that I do not accept returns nor issue refunds, I was under no obligation to issue a refund. 

    From Etsy’s mediation team in our case log,

    “As there was no return agreement in place, we're not able to mediate this dispute.”

    ”Please understand that it's imperative to have a return agreement with the seller (via Etsy Messages) before shipping an order back. In the future, please make sure to contact your seller first to arrange an agreement.”

    I am rejecting this response because:  Business stated to BBB they do not accept returns.  Business stated to me via email communications they did accept returns but would not if anyone placed a negative comment about their product which is coercion.  Further I requested the articles I PAID FOR AND BUSINESS KEPT to be returned to me.  They KEPT THE ARTICLES AND MY $$$$.  This is a scam...

    The item you purchased is incontrovertibly listed as “Final Sale.”

    Vendors are legally permitted to institute such policies under which they are not obligated to issue refunds after the point of sale.

    Etsy’s mediation team concurred and closed the case. 

    I’m not debating it further.
