      On 9-27-22, I engaged ****** ******************** of Above All Tree Experts for a 4-day job entailing removing 10 trees from my backyard, installing an irrigation system and numerous other projects. Mr. ******************** advertised that he was a certified arborist, fully licensed and insured. Work began the next day. Mr. ******************** requested payment of $4000 upfront. He brought a crew of 5 people who operated chainsaws and other heavy machinery all day. They removed 5 trees from the yard, and when I went out to talk to Mr. ******************** about the other 5, he lied about what they had done, saying they'd already removed all 10 and that clearing 5 more would cost an additional $2500. He demanded an additional $6000 secondary payment to proceed with the next part of the project. Later that evening I walked the yard and confirmed that only 5 trees had been removed. I also witnessed his crew stealing some materials from our property upon leaving. That night online, I found an old story on the local TV news about Mr. ********************* previous fraudulent business dealings. The next morning I confronted him. We called his insurance company together, and they clarified that he did not have insurance coverage for any employees. He is not licensed, nor is he an arborist. I cancelled the rest of the project, telling him I'd called my bank to cancel the previous day's checks. The bank employee had said they should not have gone through because they don't cash checks same day. He was mistaken. Mr. ******************** pretended he had received nothing and negotiated an additional $3000 to cover his costs and the work that had been done (removal of 5 trees and nothing else). Upon learning of the overpayment, I contacted him to discuss it and he agreed to meet on 10-21-22 to return $8500. He cancelled the meeting. On 10-28-22 he said he'd sent a check in the mail. It never came. On 11-4-22 I sent him a letter via certified mail demanding payment.. Text messages show that he agrees to the refund, but I haven't heard back.

      On Sept 1, there was a door to door solicitation for tree service. I had a tree that needed to be removed. I asked for some specifics of the company, and knowing that they had engaged with one other person on the street several months ago with OK results, continued discussions on my needs and the scope of the work. We agreed to a price, and we also agreed to a scope of work. That scope included the removal of a Bradford ***** the cutting up of the limbs over 3 inches into firewood, the grinding out of the *****, and the removal of all debris from the premises. During the removal of the tree, *** told me that he would be coming back on Friday or Saturday to remove the *****. During the removal of the tree, several larger limbs were dropped into my neighbors yard. I told them twice while they were still here to get those limbs. They told me that they would pull the truck around to the other street and request permission to remove the limbs from their yard. When it was still there the next day, I texted *** and asked him to get those limbs. On Friday, I received a call from *** telling me that he would be coming to grind out the ***** on Saturday. I reminded him again about the other limbs. I agreed to let him proceed. Today is Sunday morning. The limbs are still in my neighbors yard. The ***** is still in the ground. And the logs he said he would cut up so that I could burn them in a firepit, are still in the yard. The minor debris is gone. I have stacked the wood myself just to help clean up my yard. *** is now blocking my texts and calls. From my prospective, he does not intend to complete the job. I want the job done. He has been paid and he has cashed the check.
