He had his card on the mailbox in the park and I saw him working and told him I had some business. I needed my front and back deck painted. There was nothing written, I told him how much money I had to spend-$1500, his wife came with him and his daughter came and did some sidewalk work. I didn't ask for an itemized bill. He gave me a receipt saying yard work and deck. He was real accommodating. He is a handyman and asked to see my insurance papers and asked for copies of it. He said he could do the job for the money they are giving me for the roofing and siding. I said well ok. On **** 13th, he and his daughter came out and said they needed $4000 deposit for roofing. On July 11th, he didn't show up. I broke my wrist in May and kind of let it slide. I'm 86 years old. This is when he told me his brother is coming from Colorado to help him, he said he had 2 jobs and would get with me as soon as he could do it. He said he would do it in the fall. I asked him to return my money. I told him I would take legal action. He said he would return my money and I told him I'm going to get a lawyer. I told him to just return my money. In all of August and September he never gave me a date for coming back to do any work or to return my money.

I would like a refund of my money in full.

This is an unfortunate situation on both ends. First off I would like to acknowledge the stress and frustration felt by all parties involved here.

A deposit for services was accepted. At no point was there  any intent to not perform the services that were secured, as scheduled. The job was agreed upon to start in fall, and would have been completed as expected. A cancelation of services was requested in mid August, weeks before the scheduled start. As a small company I outsourced labor and services to perform these larger tasks, as was made clear. Hours get put into these things before the work ever starts. I turned other jobs down to schedule this and have also received a loss here.

A proposal of resolution was attempted on my end.

I do not wish to be unfair, unreasonable,  or unwilling to come to a fair resolution.

I will work openly with all parties in regards to any complaint, and am willing to provide any and all documentation that I have.

In closing I can only say again that this is felt by me too, and I am genuinely wishing for a fair resolution.

I am rejecting this response because:

He is not telling the whole story. He makes it sound like he spent all summer getting ready to do my job. He worked on many jobs right here in the park but I never laid eyes on him since he got the money in ****.

    Sincerely,

All larger jobs are scheduled to provide better accommodation and attention to the tasks at hand. Smaller jobs, jobs that take a couple hours to a day, are often used to fill the gap so to speak.

As included in our text message history, no large jobs were placed ahead of you. There was, at the time, one current large project that had been scheduled for some time (please refer to the text message history for details). An attempt to get to your job faster was being made, and would have gotten to your job at least a couple of weeks ahead of schedule.

During the period of time that is scheduled for any persons job I allow for a few days, after the anticipated finish, for minimal work to account for possibly not meeting the deadline for unforseen purposes. It's necessary for the scheduling to complete larger projects like this, I follow them as best as I can, for everyone's benefit.

Again, I would like to say that understand the frustrations on this subject, and I hope for a fair resolution.

I am rejecting this response because: None of Mr. Snow's responses explain why he refuses to return my $4,000.00. It certainly was not a gift.  I had the right to change my mind and I had good reasons to. I am really in need of the money to pay for expenses that I incurred to pay for the repairs that the insurance money was meant for , (leaking roof) etc. I asked for the deposit back in plenty of time and I do not believe that he had even started anything yet on my job. If he did , he certainly didn't give me any notice, date , notification of work might start.  Fall is not a date!

I went to small claims court.  i really did not want to do this but he has made no attempt to return any of the money.   I can't just go on this way. I  have to get the money from somehere and am in no position to make loan payments for the balance of these bills that he has my money for.  I think he has already spent the money .

    Sincerely,   **** ******

does this mean that All Sorts Handyman is allowed to keep the 4,000.00 deposit   I gave to him in good faith and does not have to repay one cent back to me because I changed my mind in using him for the work? I had bad feelings from some of his  excuses. I can't believe this is how you are handling this problem for me.This is like being robbed of my hard earned money.
