Signed the contract on 11/25/24.Job was supposed to be completed by Christmas ******** roof Installed on 12/12/24. Apparently some parts of roof are missing shingles along edges and some shingles have missing pieces.Gutter Guards were completed on 2-7-25 but not the promised color of black to help with ice dam melt. At least some of them appear to be damaged and crooked with holes in them.Siding has numerous marks and debris still on it from tear off of old roof.Communication was poor during entire process.Would like the silver gutter guards replaced with black ones as promised, all siding with debris cleaned, and all missing or damaged shingles repaired. Would like final pictures of all work completed before issuing any final payment along with a lien waiver and promise to honor the 10 year warranty.While the owner previously had agreed to accept a lower final payment for the gutter guards and siding power wash, this was before damage to the shingles was noted and has now said that the 10 year warranty is voided and threatening legal action and a mechanics lien.Business Response

The roofing portion of this contract was completed prior to Christmas. 12/19/2024. I agreed to the discount then the customer wanted to change the agreement. Then had a third party on our roof without anyone from our company present which voids our warranty.
Here is a reasonable solution, **** ***** from Happy Roof and a ******* representing our company will meet ******* and his ********* at the home on an agreed upon day. We will complete all items of concern. The ********* can stay and supervise our work, we will be present with a notarized lien wavier, a copy of the warranty, and a final paid invoice in hand, however we expect payment in full that day, before we leave the property.
I will contact our attorney and stop the lien process today; however, I want to have a clear path to resolution no later than 2/17 or I'm moving forward with the lien. I will honor the warranty, clean the siding, repair whatever shingles defective, and change the gutter guard. However, ******* asked us as of yesterday to contract additional work on his soffit and fascia and I'm not willing to complete this work. This is outside our scope of contract, and I'm not interested.

I have reviewed the business' response and am rejecting it. At this point, I don't feel comfortable having anymore work performed by Happy Roof due to the legal threats and unwillingness to acknowledge and repair all issues noted.In addition:
1. I have asked for a copy of the company's W9 Form and COI (Certificate of Insurance) for Happy Roof LLC and the subcontractors who completed the job but still haven't received either. Please provide.
2. I haven't received a copy of the terms of the roof contract or warranty information. It was noted that the warranty information is provided only after the final payment which for all I know may include limited to no actual coverage or large deductibles. Please provide copy of the warranty agreement.
3. I had another roofer come out today to give me a repair estimate on the damaged and missing shingles. Their minimum for any repair job is $1,500 which would include removing and replacing all of the damaged shingles.
In closing, at this time, I will agree to make a final CC payment tomorrow 2-13-25 only of $2,046.51 (Remaining balance was $3,046.51 - $1,000.00 for part of shingle repair work) upon issuance of a final invoice and subsequent notarized Lien Waiver using your payment link provided and immediately cancel the disputed charge of 4,914.96 with Discover.
Please let me know if you agree and send final invoice no later than 5:00PM CST 2/13/25.Sincerely,

3/24/2025 PE: Phone call into the consumer to let him know that we can continue with mediation through bbb even though both parties have hired lawyers. Asked him to call me back on my direct line and let me know if he wants to proceed.
3/28/2025 PE: Email from consumer with itemized request for repairs, resolutions to the complaint to be made by Happy Roof. This is what I was asking for but they haven't responded.
1. Happy Roof to provide W-9, COI (For Happy Roof LLC and Subcontractor that installed roof), and confirm terms of warranty (there seems to be conflicting information 10- year labor warranty on proposal but the warranty in the terms and conditions are confusing and reference a 2-year warranty). Would also like to receive a copy of the Warranty Agreement for review before issuing final payment.2. Happy Roof to complete repairs:1. Provide complete list of repairs done and take new pictures of entire house and garage with Before and After work pictures.2. Touch up any of the scratched gutters with spray paint.3. Clean all the siding from the roofing debris.4. Replace the gutter guards with black ones and install hidden hangers to ensure all of the gutters are straight.5. Repair and replace any missing soffit pieces found during inspection and also as pointed out in previous pictures.6. Replace all damaged shingles including but not limited to ones that have holes or missing chunks, ones where they don't go all the way to the edges, ones that have nail pops, and trimming back the shingles on the back porch that are too long.3. Repairs to be complete on or before [3/31/25]4. Owner shall have 7 days to inspect roof and either (a) provide list of any issues in writing to Happy Roof or (b) issue payment in full online using CC.5. 4/1/2025 PE: Spoke with the business owner, *****. He said that he offered the consumer approximately $2000 discount which, initially, the consumer accepted, then the next day, the consumer called and wanted $3400.

I had gotten my shingles and fascia replaced in 2018 due to some leaks I had. Happy Roofing completed the job, charging roughly $11,000. Included in this, was a 10 year warranty on their work.Starting a few months after, shingles would randomly just fall off the roof, and I would need to call them to have them put back up. This never stopped. I've had to call them every few months since then to have shingles fixed. They used to tell me that the reason is because the crew that did it, wasn't a very good crew and apologized profusely. Told me those particular men didn't work for them anymore. The reasoning didn't matter, as they kept falling. Then I was told it was because of a manufacturing problem with the shingle themselves, and they would need to contact the manufacturer to possibly re-do the roof. This hasn't happened either. I've called this year several times, and still haven't gotten my shingles fixed. I still have two years left on this warranty.Business Response

I have reviewed the response made by the business in reference tocomplaint ID ********, and yes, it is true that I went to their office to confront them. I found that there seems to be some miscommunication, as messages were not being delivered to them by their answering service. Also, we did discuss some long term solutions to the issues that were ongoing. Was supposed to hear back from them today, Thursday September 5th, but have not. It is now 5pm. I had to send them a message again, but have not heard back.
