In August 2022, Better Business Bureau questioned Styles Home Furnishings mailer which stated, “$2,000,000 GOING OUT OF BUSINESS SALE!”.
The BBB Code of Advertising states, “Emergency or distress sales, including but not limited to bankruptcy, liquidation and going-out-of-business sales, must not be advertised unless the stated or implied reason is a fact; be limited to a stated period of time; and offer only such products or services as are affected by the emergency. Where the advertiser states that it is going out of business or closing down, it must actually be going out of business or closing down. Where the advertiser is not going out of business or closing down, it can advertise that it is ‘selling out’ a product or ‘closing out’ particular merchandise, as long as that advertiser will no longer carry that product or merchandise. The unqualified term ‘liquidation sale’ means that the advertiser's entire business is in the process of actually being liquidated prior to actual closing. If such sales exceed ninety (90) days, advertisers must be prepared to substantiate that the offering is indeed a valid emergency or distress sale”.
Furthermore, according to the Missouri Attorney General’s Office, any type of sale referencing “going out of business” or “liquidation” should not be advertised or conducted unless it registered with that office.
BBB questioned the lease agreement, time frame of sale, merchandise and if it had registered the sale with the state. The company responded to BBB's lease agreement inquiry but failed to answer any other questions.
