    There was H37**38323132313537H contract fraud and misrepresentation. He overcharged me and didn&#**;t complete the work on time. It has taken them 4 years to build the house and he went 6 months at a time without working on the house, refused to meet with in person over the past 2 years, he charged for extra things not covered in the contract, he never finished the items nor did the walkthrough for the occupancy permit. I would like a refund.

    We entered into a contract to build a home for ****** which included his brother and ************ and had several meetings along the way.. It did not take 4 years to construct. It may have been since engaging the architect it was 4 years.. towards the end his brother and ************ left the lake and did not wan the house anymore so ****** decided to sell it. It was listed and Sold before it was complete. When we build a home we give allowances for what we have plugged in to the number to start with. when you add light fixtures or add additional cabinetry etc etc. and it drives the price over you allowance you have to pay the difference. towards the end of the build we audit the allowances and if you did not go over your allowance like the front door you have a credit, if you go over on lighting you have a debit, straight forward.. we prepared that for ****** and sent it to him. Heard not one word for but as I remember it was several months and not one word, rebuttal, comment nothing.. then the closing came with the buyer and ******, Then ****** did not want to pay the final draw on the original price let alone the extras. so we mutually agreed to pay the final on the contract which was 50K and the 23K and some change would be put in escrow with the title company and the buyer then closed and ****** was paid in full, leaving the 23k in escrow with a signed agreement by ****** the Buyer and title company that when the punch list after the walk through was complete and all bills submitted were paid the buyer would sign off the everything was complete and instructed the title company to pay forward the 23k to us.. job done. a few weeks later ****** demands that the funds get returned to the title company?? the title comp[any has a signed escrow agreement ****** signed and all of a sudden after Months and months with no rebuttal or comment to the allowance audit ****** make all these claims he thinks I should split all these extras with him.. it is non sense.. I am a fair person and what he sent me that I agree with is some electricity but he did have his pool running, dock etc and we are not talking much but I will agree to pay him for that.. Note I have built for 40 years and some 250 homes I have never had a complaint to the BBB.. ****** also turned me and the title company into the Attorney General  claiming Fraud which is a false claim.. he needs to be careful on accusations..

    I have reviewed the business' response and am rejecting it because:

    ********** has mis stated the Contract Parties: Contract was between ****** **** and ********** Development. My brother & ************ were NOT part of this contract. (See attached copy of the Contract Names) 

    ********** has missed stated the timeline as it did take 4 years to completion from time of Deposit & ***************** The decision to sell the home was the matter of dissatisfaction, refusing to meet on sight as requested, numerous times haunting construction process as long as 6 months at a time and misrepresentation of the contract, raising the costs to his advantage and not per the contract. This is mismanagement and fraud. 

    ********** is mis stated house was sold prior to completion and he claims the $50,000 Final Draw Walk Through per the Contract Agreement he dated an Invoice January 23, 2025. He never scheduled the Final Walk Through with ****** **** and refused to meet in person. The house was NOT completed on January 23, 2025 and he was requesting Final Payment. (See Attached Draw 5 dated 1/23/25 which was NOT Payable)

    ************ Final Draw & Overage Invoices were NOT accepted and he was informed that verbally by ****** ****. He did not fulfill the Contract and still had not completely finish the home. The Overage Invoices were NOT agreed & over charged. So he was informed that and agreed to Escrow the Overage Invoices until we settled on those charges. 

    The Escrow Agreement (See Attached) clearly states "between ****** **** **** & ********** Developements. The Buyers contacted ****** **** numerous times advising the house completion list was NOT completed per the *********** Contract & the Escrow Agreement. I advised the title company on March 25, 2025 in writing that the Escrow Amount was NOT to be transferred as the Contract Agreement was NOT fulfilled. The completion was not finished on time and ****** **** had NOT settled the Overage Invoices with ********** ************************************************ has a claim also as they defaulted the Escrow Agreement (See Attached) as it was NOT fulfilled on time as stated per contract by March 24, 2025 Line #4 on the contract. 

    ********** has mis stated he has no other claims on his business. He currently has a legal complaint on a home he constructed in Shooter's 21 Development Project. He also has a bad reputation as a contractor around Lake of the Ozarks. 

    ************ comment about ****** **** needs to be careful on accusations is absurd! He is clearly fraudulent and this case has the facts to prove it!
