I am a ************ **** ******** ***** service member being denied appropriate interest rate reductions under Pennsylvania title 51 section 7316 laws by Pioneer military credit I have supplied appropriate military orders and transfer order showing that I am a ************ **** ******** *****sman and I’m being denied because their claim is I am not a ************ **** ******** *****sman and have denied to further review my interest rate reduction as required by law.Business Response

Military Credit is in receipt of complaint ** ******** filed by **** ******* regarding the Pennsylvania provision regarding the Soldiers and Servicemembers
Civil Relief Act (“SCRA”). Pioneer Military Credit LLC strives for the best in
customer satisfaction and appreciates the opportunity to assist you.
The SCRA allows
a service member to request a creditor reduce the rate of interest to six
percent (6%) only for financial obligations that were incurred prior to
the service member entering military service.
We have
reviewed the Pennsylvania provision with our council and our response is in
accordance with their guidance. Pennsylvania’s maximum rate of interest in 51
Pa. C.S.A. § 7316 applies to members of the ************ ******** ***** and
members of other reserve components who are called or ordered to active duty.
Since you are neither a member of the ************ ******** ***** nor a member
of another reserve component of the armed forces and were on active-duty status
when you applied and received your loan, your account does not qualify for the
maximum rate of interest under 51 Pa.C.S.A. § 7316.

As a member of the United States Army currently serving on Active Duty for the nearly 16 years in the key provision state of Louisiana I have respectfully requested as of August 2024 an application of SCRA benefits to Pioneer military lending using the state statute of Louisiana Universal Citation: LA Rev Stat § 29:312
§312. Limits on creditor interest rates
A. Notwithstanding any provision of law to the contrary, no creditor in connection with an obligation entered into on or after June 29, 2005, shall charge or collect from a person, or spouse of a person, who is on active duty interest or finance charges exceeding six percent per annum during the period that the person is deployed on active duty.
B. Notwithstanding any provision of law to the contrary, interest or finance charges in excess of six percent per annum that otherwise would be incurred but for the prohibition in Subsection A of this Section are forgiven.
C. The amount of any periodic payment due from a person, or spouse of a person, who is on active duty under the terms of the obligation shall be reduced by the amount of the interest and finance charges forgiven under Subsection B of this Section that is allocable to the period for which the periodic payment is made.
I was informed we do not show a financial hardship and therefore do not qualify. As the statute reads we are required to meet a financial hardship just furnish military orders and written notice to which we have to no avail. We are requesting that appropriate consideration be given based on the state law and documents there provided. I am requesting that overage of interest in excess of 6% be applied towards the account and any additional fees that would invite a higher than 6% rate additionally be refunded.Business Response

of the Servicemembers’ Civil Relief Act. Pioneer Military Credit strives for

Louisiana’s version of the SCRA rate cap allows a service member
to request a creditor reduce the rate of interest to six percent (6%) applies
to “any retail installment sales contract, other contract for the purchase of
goods or services, or bond, bill, note, or other instrument of writing for the
payment of money arising out of the contract or other transaction for the
purchase of goods or services.” LA Rev Stat § 29:311(3). As your loan with
Pioneer Military Credit is a personal installment loan, your account does not
qualify for the requested reduction in your interest rate.

On 23 July 2024, I sarted an application for a personal loan, the loan process is 4 stages (personal information; disclosure forms, decisions and loan). I completed the personal information, clicked continue and read the disclosure forms clicked continue No WHERES on the credit disclosure form does it staed "by clicking continue below you are authrizing Pioneer loan to pull a credit report') after considering the interest rate of 35.99% I decided not to continue the application and logged out the site. The merchant ran my personal information pulling a credit report without my permission. I called the merchant and spoke with ******** (Lending Manager) she stated that by me clicking on the Continue button to go to the next page that gave them authorization to process an ncomplete application for a loan and the pulling of my credit report. Spoke with Experian and they said the merchant has to remove themselves from my credit report inquiry record.Business Response

Please be advised Pioneer Military Credit accepts online
applications from active-duty service members. As part of our application
process, we provide applicants with all federal and state regulated lending
disclosures, such as the Credit Pull Authorization, Terms of Use, and Privacy
Policy Notices. This information is found on our Disclosure Agreements page
which applicants must review prior to proceeding with the application.
The Disclosure Agreements page of the application states: By
clicking the “Continue” button below, I acknowledge I have reviewed and agreed
to the following agreements, consents, and disclosures and that this shall
constitute my signature.
The Credit Pull Disclosure provided prior to the credit
inquiry states: By providing your consent electronically, you authorize and are
providing written instructions for Lender to check your credit and employment
history.
Upon receipt of the complaint, we completed a thorough
review of the complainant’s application. The records reflect that on July 23,
2024, at 7:00 AM, Pioneer Military Credit received the complainant’s electronic
authorization to obtain a credit report. As such, the inquiry was authorized
and permissible under the Fair Credit Reporting Act (“FCRA”).

As stated in our original response, as part of our
application process, we provide applicants with all federal and state regulated
lending disclosures, such as the Credit Pull Authorization, Terms of Use, and

We understand that Ms. ****** disagrees; however, she

The Servicemembers Civil Relief Act (SCRA) caps personal loans and credit APR at 36%
Pioneer "Military" finacial has their loans at 35.98%. The fact they use the term Military in their name is disrespectful to the men and women who serve.
They have with both myself and Soldiers under me tried to lend money at these ridiculous rates and then put the intrest at 35.98%, they don't even try to hide that they are trying to utilize the system to their advantage.
Luckily for us in the Military they are blacklisted and they are not at all endorsed or recognized by the Federal Government, State Guards, or the DOD at all.
This company are sharks that prey on our enlisted service members and will in every way try to strong arm you if you miss a payment. I've had Soldiers receive emails where they threaten court action.
This type of company has no buisness attempting to align itself with the Military or try to talk about how they are trying to help service members out.
Although this review won't stop them as they have plenty of other reviews explaining how disrespectful this company is. I hope it helps someone who would read this not go into buisness with them.Business Response

for the best in customer satisfaction and appreciate the opportunity to

Upon receipt of the complaint, Pioneer Military Credit completed
a thorough review of our loan system and was unable to find any record of the
complainant in our system with either an application for credit or opened loan
and the allegations regarding our business practices are false.
Pioneer Military Credit provides personal installment loans
to active-duty military and our interest rates fully comply with the Military
Lending Act (“MLA”) which caps the interest rate at 36%. Any request made from
customers under the Servicemembers Civil Relief (“SCRA”) interest rate
reduction are reviewed on an individual basis.
We do not claim to be endorsed by or affiliated with the
department of defense and are very clear in our advertising and ongoing
communication with customers to note that no military endorsement is implied.
With regard to missed payments, Pioneer Military Credit
fully complies with the Fair Debt Collection Practices Act (“FDCPA”) and will
always attempt to work with servicemembers to resolve any delinquency. Pioneer
Military Credit does not threaten legal action in any form of communication,
verbal or in writing, with our customers.

On 13 June I received an email from the company stating my account is past due stating the will report me to the credit bureaus. 21 May I contacted the company to change my payment date as my pay date changed. I was sent an email stating that my date would be changed. I have since contacted the company speaking to a phone representative but was told that the payment date was not changed and will not be changed.Customer Answer
