I am writing to address a severe and ongoing issue regarding the habitability of my apartment at ***** ********* ******]. Over the course of my tenancy, I have experienced **three separate incidents where my apartment was rendered uninhabitable**.

Specifically, this includes two prior relocations due to issues, and most recently, a significant incident involving **worsening leaky pipes** that again made my apartment uninhabitable. During this last incident, the decision to relocate me to my current unit was made under extreme duress, as I was faced with a **sopping wet and unlivable apartment**. This was an emergency decision, not a compensation for the recurring issues or a new, binding lease agreement.

Crucially, it was **expressly agreed upon in writing by a previous leasing agent that I would be able to move out without penalty** due to the repeated uninhabitability and the broken lease agreement. Unfortunately, it appears this critical agreement was not communicated to the current leasing team, leading to a new lease being signed under duress and the current penalties I am facing.

Given that my apartment has been uninhabitable on three separate occasions, the original lease agreement has been fundamentally broken, as well as the agreement with the previous leasing agent about terminating my lease. I no longer wish to reside at Lucas Place Lofts and firmly believe I should be able to **vacate my lease without any repercussions or penalties.**

I have extensive photos and videos documenting the conditions of the apartment during these incidents, which I can provide upon request.

I respectfully request that Lucas Place Lofts honor the agreement made regarding my ability to move out without penalty. My

    Business Response

    Date: 07/02/2025

    To whom it my concern,

We are writing in response to
the recent letter we received regarding ******* ******* and her concerns.

    In January 2025, a pipe
located above *** ********* apartment home at *** **** *** ******* ********* ***** Kansas City, MO 64105, broke and caused flooding. In an effort to resolve
the matter and accommodate her situation, *** ******* was given two options: to
transfer into another available unit onsite or to be released from her lease
agreement without penalty. She elected to transfer to another apartment located
    at *** **** *** ******* ********* ***** Kansas City, MO 64105.

    Upon her move-out from
********* ****, charges were assessed due to trash and personal items being
left behind. However, *** ******* was credited $400 from her deposit, in
accordance with a prior agreement communicated by a former property manager.

Since her transfer, *** ******* has communicated—both via email and in person—about ongoing financial
hardship and has requested to be released early from her lease without
incurring the standard lease break penalties. While we understand and empathize
with her circumstances, we want to note that there have been no reported issues
with her current apartment home at #309. Please let it be known that *** ******* has lived in her current apartment home for six months with no issues.

    Lucas Place Lofts has made
every reasonable effort to accommodate *** ******* throughout this process. As
outlined in her current and signed lease agreement, she would be required to
submit a 30-day written notice along with payment of the lease Buy-Out fee
totaling $2,408.00 in order to terminate her lease early.

    Please feel free to contact
our office should you have any further questions or require additional
    documentation.

    Kind regards,

    ******** *******
